R-89 - Sri' 4 5 A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER NO. 232-1 FOR LA COSTA SHOPPES PROJECT FOR A FINAL SITE PLAN PURSUANT TO THE PROVISIONS OF 6 SECTIONS 7-2 THROIJOH 7-11 OF THE TAMARAC CODE; AND PROVIDING AN EFFECTIVE DATE. 7 _ _ WHEREAS, pursuant to the instructions of the City Council of Tamarac, Florida, a public meeting has been 9 advertised in accordance with applicable law of the date, 10 time and place of the meeting regarding the review of the 11 application for a revised development order by the applicant 12 for development approval; and 13 WHEREAS, the City Council has examined and investigated 14 the application, staff and Planning Commission recommenda- 15 bons, and the attached development Review Status Sheet dated 16 August 11, 1989; and 17 WHEREAS, the City Council reviewed the revised develop- 18 ment order and accompanying documents at a public meeting; 19 and 2 WHEREAS, the City Council has determined that the appli- 2 cation is in compliance with all elements of the Comprehen- 221 sive Plan, or will be in compliance prior to the issuance of 23 a Certificate of Occupancy for the development that is the 24 subject of the application. 25 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 26 TAMARAC, FLORIDA: 27 SECTION 1: That the development described on the 28 attached Development Review Status Sheet dated August 11, 29 1989 is granted a revised development order' to proceed 30 subject to the following conditions: 31 A. Reso. #5531 B. Commencement of construction shall be no longer than one year from the date of this approval. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The revised development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the revised development order are set forth as follows: a. Waiver of 20 foot wide landscape buffer to a 10 foot wide buffer with berms and shrubs. SECTION 2: That the following documents are hereby accepted and approved as a part of this revised development order: 1. Water and Sewer Developer's Agreement 2. Tamarac Utilities West Water and Sewer Utility Easement 3. Partial Subordination of Encumbrance to Property Rights SECTION 3: Should any section or provision of this revised development order be declared by a court of competent jurisdiction to be invalid, the City Council shall deter- mine if the other portions of the order remain valid or whether the approval. shall be null and void. SECTION 4: This revised development order as condi- tioned shall become effective immediately upon its passage.
