CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-89- A ?I
A RESOLUTION DECLARING NULL AND VOID A DEVELOPERS
AGREEMENT DATED NOVEMBER 17, 1986 AND ALL OF ITS
AMENDMENTS BETWEEN TRACT 37 CORP. AND THE CITY OF
TAMARAC PERTAINING TO CINNAMON WHARF (TRACT 37);
AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, the City entered into a Developers Agreement,
as amended, with Tract 37 Corp., pertaining to the payment of

development fees and extension of the site plan for the
property known as Cinnamon Wharf (Tract 37), which agreements
dated November 17, 1986 was recorded in Plat Book 125, Page
18, of the public records of Broward County, Florida; and
WHEREAS, Tract 37 Corp. has failed to pay the
development fees in the amounts set forth in Exhibit "A" to
the November 17, 1986 Developer's Agreement, as amended,
which automatically causes the site plan for Cinnamon Wharf
to be deemed null and void; and
WHEREAS, Tract 37 Corp. has further sold the subject
property to Reynolds Metals Development Corp. for the
proposed Westwood Pines development; and
WHEREAS, the City Council wishes to declare this
agreement null and void.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the
Developer's Agreement
dated

November 17, 1986, as amended, between Tract 37 Corp.
and the

City of Tamarac, and recorded in Plat Book 125, Page
18, of
the public records of Broward
County, Florida, is
hereby
declared null and void.

SECTION 2: That the City
Clerk is hereby directed
to

record this Resolution in the public records of Broward
County, Florida.
SECTION 3: That the City Clerk is hereby directed to
transmit a certified copy of this Resolution to Michael J.
Toll.

SECTION 4: This Resolution shall become effective
immediately upon adoption.
