R-89--5I A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER NO. 250 FOR MARKETPLACE AT TAMARAC SITE PLAN PURSUANT TO THE PROVZSIONS'OF SECTIONS 7-2 THROUGH 7-11 OF THE TAMARAC CODE AND SUBJECT TO CERTAIN CONDITIONS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council. of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law stating the date, time and place of this meeting regarding review of the subjection application for a revised development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommenda- tions, and the attached Development Review Status Sheet dated March 3, 1989; and WHEREAS, the City Council reviewed the revised develop- ment order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the application is in compliance with all elements of the Compre- hensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application; and WHEREAS, RK Development Corp. is the contract vendee for that certain property which is subject to the Marketplace of Tamarac Revised Final Site plan; and ac Temp. Reso. #5334 `a era 22 23 24 WHEREAS, RK Development Corp. will not become the record title owner of the property subject to the Marketplace at Tamarac Final Site Plan until such time as a real estate closing takes place on the property within the next few weeks; and WHEREAS, RK Development Corp. has submitted a check tc be held by the City in escrow and which check covers the cost of all development fees required under the City Code; and WHEREAS, RK Development Corp. has submitted a Water and Sewer Developer's Agreement, a Blanket Public Safety Ingress/ Egress Easement, a Water Retention Agreement, a Median Maintenance Agreement and a Water/Sewer Easement which will be held in escrow by the City; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 That the development described on the attached Development Review Status Sheet dated March 3, 1989 is granted a development order to proceed subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status oheet and approved engineering drawings. B. Commencement of construction shall be- no longer than one year from the date of approval. If the development does not commence construction within 36 1 - 2 - Temp. Reso. #5334 30, 33 34 35 36 one year, the approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The revised development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the revised development order are set forth as follows: That the revised final site plan and related documents referenced above for The Marketplace at Tamarac attached hereto as Exhibit "A" is hereby approved subject to the following: 1. On or before July 1, 1989, RK Development Corp. shall notify the City Clerk in writing that the real estate closing for the subject property has taken place at which time the City Clerk shall record the subject Water and Sewer Developers Agreement, Blanket Public Safety Ingress/Egress Easement, Water Retention Agreement, Median Maintenance Agreement, Water/Sewer Easement and special Warranty Deed for the vacated right-of-way on the south side of N.W. 57th Street for The Marketplace at Tamarac. Developer shall also supply City Clerk with an updated Title Opinion prior to City Clerk recording the subject documents. At the same time the Finance -Director shall release from escrow for deposit in the ac Temp. Reso. #5334 appropriate City account(s) the check(s) from RK Development Corp. for fees, including, but not limited to, for Water and Sewer, Drainage, Beauti- fication and Road Impact fees, all required for the Marketplace at Tamarac project. If a mortgage is placed on the subject property prior to the recordation of the documents referenced above, RK Development Corp. will provide the City Clerk with new Agreements executed by the Mortgagee evidencing the Mortgagee's consent and recognition that in the event of foreclosure the mortgagee will continue to recognize the rights of the City in accordance with the terms of the Agreements; or 2. On or before July 1, 1989, RK Development Corp. shall notify the City Clerk in writing that the closing will not take place and all required documents and funds held in escrow shall be returned to RK Development Corp. and the approval of the revised final site development plan sub- mitted by RK Development Corp. and this development Order shall automatically be null and void with no vested rights. 3. If neither of the conditions outlined in paragraphs 1 or 2 has occurred by August 1, 1989 then the final site development plan submitted by RK Development Corp. shall automatically be null and void with no vested rights to RK Development Corp. nor any other person or entity and all required documents, agreements, deeds, and funds held in escrow shall be returned to RK Development Corp. -4- Temp. Reso. #5334 SECTION 2 : Should any section or provision of this revised development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void.
