CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-89- J S
A RESOLUTION OF THE CITY OF TAMARAC RELATING
TO THE PUBLIC WORKS PROPERTY AT THE CORNER OF
COMMERCIAL BOULEVARD AND N.W. 88TH AVENUE;
AUTHORIZING THE CITY MANAGER TO EXECUTE AN
AFFIDAVIT REPEALING THOSE CERTAIN DECLARA-
TION OF RESTRICTIONS RECORDED JULY 14, 1969
IN O.R. BOOK 3976 AT PAGE 696 OF THE PUBLIC
RECORDS OF BROWARD COUNTY FLORIDA, AND WHICH
ENCUMBER THE SUBJECT PUBLIC WORKS PROPERTY;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac is the owner of that
certain property located at the corner of Commercial Boule-
vard and N.W. 88th Avenue, more particularly described as
lots 2 through 15 in Block 8 of Lyons Commercial Subdivision,
according to the plat thereof, recorded in Plat' Book 69 at
Page 42 of the Public Records of Broward County, Florida; and
WHEREAS, the City wishes to repeal those certain
Declaration of Restrictions recorded July 14, 1969 in O.R.
Book 3976 at Page 696 of the Public Records of Broward
County, Florida which Declarations of Restrictions encumber
the property owned by the City as referenced above;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1 : That the City Manager is hereby authorized
to execute the affidavit attached hereto and incorporated
herein as Exhibit "A", which affidavit repeals those certain
Declaration of Restrictions recorded July 14, 1969 in O.R.
Book 3976 and which currently encumber the Public Works
Property at the corner of Commercial Boulevard and N-.W. 88th
Avenue.

SECTION 2 This Resolution shall become effective
immediately upon its adoption.

2. That the above -described property is encumbered by Declaration of
Restrictions recorded July 14, 1969 in O.R. Hook 3976 at Page 696 of the
Public Records of Broward Gbunty, Florida.
3. That it is the express desire of the Affiant(s) herein to have the
. above -described Declaration of Restrictions repealed in their entirety,
forever, and be of no further force or effect on the properties encumbered by
said Restrictions.
4. Mmt the Affiant(s), pursuant to Paragraph 17 of the above -
Declaration of Restrictions, hereby agrees to repeal the Declaration
of Restrictions, the covenants, restrictions, reservations and servitudes set
forth therein.
