A RESOLUTION AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO WAIVE THE BIDDING REQUIREMENTS AND
EXECUTE AN AGREEMENT WITH KEY CONTROLS, INC., FOR
THE PURCHASE OF TWO TEN -INCH ACTUATOR VALVES FOR
THE TREATMENT PLANT FILTRATION EQUIPMENT; AND
PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That the appropriate City officials hereby
waive the bidding requirements and are authorized to execute
an Agreement with Key Controls, Inc., for the purchase of two
ten -inch actuator valves for the Treatment Plant filtration
equipment, in the amount of $4,480.00, a copy of said agree-
ment being attached hereto as "Exhibit 1".
SECTION 2: This Resolution shall become effective upon
adoption.

AGREEMENT BETWEEN
THE,
CITY OF TAMARAC

KEY CONTROLS INC.
RELATING TO THE PURCHASE OF
BUTTERFLY ACTUATOR VALVES
This is an Agreement between the City of Tamarac, a
Florida municipal corporation ("City"), and Key Controls,
• Inc., a Florida corporation, its successors and assigns ("Key
Controls, Inc.").
W I T N E S S E T H•
WHEREAS, the City of Tamarac has determined that it must
purchase two (2) Butterfly Actuator Valves on the Treatment
Plant filtration equipment to replace worn and attritted
units; and
WHEREAS, the required Butterfly Actuator Valves must be
• a direct replacement of the existing installed units used by
the Water Treatment Filters and, therefore, the purchase of
these devices is a sole source purchase; and
WHEREAS, Section 9-39 of the City of Tamarac Cade of
Ordinances requires that sole source purchases in an amount
over two thousand dollars ($2,000.00) be the subject of a
formal written contract approved by the City Council.
NOW, THEREFORE, IN CONSIDERATION of the mutual terms and
conditions, promises, covenants and payment hereinafter
set forth "City" and "Key Controls, Inc." agree as

2. Key Controls, Inc. agrees to ' g provide and the City

agrees to purchase two (2) ten inch (10') Butterfly
Actuator Valves: Fisher Type 1011, 1052K-9500
Butterfly Actuator Valves. The price for these
valves is four thousand four hundred dollars
($4,480.00).

3. The "City" and "Key Controls, Inc." agreed that the
above quoted price shall include delivery of the
aforementioned valves.
IN WITNESS whereof, the parties hereto have made and
executed this Agreement on the respective dates under each
signature. The City of Tamarac signing by and through its
Mayor, authorized to execute same by City Council action on

Controls, Inc. signing by and through its Regional Repre-
sentative duly authorized to execute same.
