CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-88-
A RESOLUTION AUTHORIZING THE APPROPRIATE
CITY OFFICIALS TO EXECUTE A RELEASE AND
TERMINATION OF EASEMENT TO MIDWAY
INVESTMENTS, LTD., REGARDING TAMARAC
UTILITIES WEST RAW WATER LINE AND WELL
EASEMENT GIVEN TO THE CITY OF TAMARAC BY
MIDWAY INVESTMENTS, LTD.; AND PROVIDING AN
EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA: '
SECTION 1: That the appropriate City officials are
hereby authorized to execute the Release and Termination of
Easement, to Midway Investments, Ltd., regarding TUW raw
water line and well easement given to the City of Tamarac by
Midway Investments, Ltd.
SECTION 2: That the City Clerk is hereby authorized and
directed to record said Release and Termination of Easement
in the public records of Broward County, Florida.
SECTION 3: This Resolution shall become effective
immediately upon its adoption.

RELEASE AND TERMINATION OF EASEMENT
The CITY OF TAMARAC, a municipal corporation organized and existing under the
laws of the State of Florida, hereby remises, releases, acquits, forever
discharges, terminates, conveys and delivers in favor of and to MIDWAY
INVESTMENTS, LTD., a Florida limited partnership, its successors and assigns,
any and all right, title and interest which the CITY OF TAMARAC has by virtue
of that certain Utility Easement dated November 22, 1985, recorded January 27,
1986, in Official Records Book 13136, Page 21 of the Public Records of Broward
County, Florida, or by virtue of that certain Tamarac Utilities West Raw Water
Line and Well Easement made the 16th day of September, 1986 and recorded
December 22, 1986 in Official Records Book 14008, Page 233 of the Public
Records of Broward County, Florida, or by virtue of Resolution No. R-86-353
dated October 8, 1986, recorded in Official Records Book 14008, Page 238 of
the Public Records of Broward County, Florida, or by virtue of that certain
Bill of Sale dated September 16, 1986, and recorded on December 22, 1986 in
Official Records Book 14008, Page 228 of the Public Records of Broward County,
Florida, or by virtue of that certain Resolution No. R-86-352 dated October 8,
1986, recorded in Official Records Book 14008, Page 232 of the Public Records
of Broward County, Florida, or by virtue of the existence and/or use of the
potable water wells and associated raw water line and well easements
contemplated by or described in the aforedescribed agreements.
It is the intent hereof to reflect the termination of such easements, as well
as the discontinuance of the use of or any rights in the potable water wells
and associated raw water line and well easements contemplated by or described
in the aforedescribed agreements.
IN WITNESS WHEREOF, I have hereunto set my hand and seal this // day
of one thousand nine hundred and eighty --eight.
