A RESOLUTION OF THE CITY OF TAMARAC APPROVING AND ACCEPTING A RIGHT OF WAY DEED FOR 40-FEET ALONG LOTS 22 AND 23, BLOCK 11, AS RECORDED IN PLAT BOOK 76 AT PAGE 31, LYONS COMMERCIAL SUBDIVISION *3, ALONG UNIVERSITY DRIVE OFFERED BY PHILIP FRYBERGH, PREVIOUS OWNER & TAMARAC FORTUNE LIMITED PARTNERSHIP, PRESENT OWNER FOR THE UNIVERSITY PARK OFFICE CENTER PROJECT; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA; That the Right of Way Deed for 40-Feet along Lots 22 and 23, Block 11, Lyons Commercial Subdivision *3, Plat Book 76 at Page 31, along University Drive offered by Philip Frybergh, previous owner & Tamarac Fortune Limited Partnership, present owner for the University Park Office Center Project, is HEREBY APPROVED and accepted, a copy of said deed and Legal Survey are attached hereto and Incorporated herein as Exhibits "1" and "2" respectively; SECTION 2 The City Clerk is hereby authorized and r directed to record said Deed in the Public Records of Broward County. It is the intention of the party of the first part by this instrument to convey to the said City, and its successors in interest, the land above described for use as a public road right-of-way and for all purposes incidental thereto. The said party of the first part will defend the title to said land against the lawful claims of all persons whomsoever, claiming by, through or under it.
