Reso. *5018 CITY OF TAMARAC, FLORIDA RESOLUTION NO. R-88-Z ` A RESOLUTION OF THE CITY OF TAMARAC PROVIDING FOR PUBLIC PARTICIPATION IN THE PLANNING PROCESS ASSOCIATED WITH THE REVISION AND UPDATE OF THE CITY OF TAMARAC COMPREHENSIVE PLAN, IN ACCORDANCE WITH CHAPTER 163 F.S., THE LOCAL GOVERNMENT COMPREHENSIVE PLAN AND LAND DEVELOPMENT REGULATION ACT, AND CHAPTER 9J-5, FLORIDA ADMINISTRATIVE CODE, SECTION 9J-5.004; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Chapter 163 F.S., the Local Government Compre- hensive Planning and Land Development Regulation Act of 1987, has mandated a program of Public Participation In consideration and adoption of local Comprehensive and Land Use Plans and amendments thereto, as well as the Evaluation and Appraisal Reports required for the Comprehensive Plan and reports subsequent to the adoption of the revised plan•; and WHEREAS, the procedure set forth in the implementing chapter of the Florida Administrative Code, Chapter 9J-5, Section 9J-5.004, provides that the local governing body and the local planning agency adopt procedures to provide for and encourage public participation In the planning process and specifies the minimum requirements for the above. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 : That the City of Tamarac hereby adopts the following procedures for public participation in the planning process: 1 Temp. The City of Tamarac Planning Commission, as the 3 local planning agency, shall hold public hearings 4 on any element or a part thereof of the Comprehen- 5 sive Plan or Land Use Plan. Recommendations and 6 public Input are to be transmitted to the City Council for their consideration when adopting any element or a part thereof of the Comprehensive Plan 9 or Land Use Plan, or of amendments of any elements 10 of the Comprehensive Plan or Land Use Plan. Public 11 hearings for the City of Tamarac Planning Commis- 12 sion shall be advertised in a newspaper of general 13 circulation at least twice, the first not less than 14 14 days prior to the date of the meeting, and the 15 second at least 5 days prior to the date of the 16 meeting. The advertisement notice shall Indicate 17 the subjects to be discussed, and the date, time 18 and location of such considerations. r , 2. The City Council of the City of Tamarac shall hold at least two (2) advertised public hearings on 21 proposed revisions of the Comprehensive or Land Use 22 Plan as provided for In Chapter 163.3184 (15)(b)(c) 23 F.S.(1987). The City shall advertise the first 24 hearing,the transmittal hearing, approximately 2.5 seven days prior to the date of the hearing. The 26 second hearing, the adoption hearing, shall be 27 advertised approximately five (5) days prior to the 2$ hearing. The advertisement shall state the date, 29 time, place of the meeting, as well as the subject. 30 Such advertisements shall Indicate that the public 31 is invited to attend the meeting and to participate In the public hearing and that members of the public may also submit written comments which will 34 be made part of the record and will be considered 35 by the City Council in their final recommendations 36 and decision actions. 3. Reso. #5018 information at regular Intervals to keep the citizens apprised of the planning activities. 4. The City Council shall appoint the City Planner to be available to meet with and receive Input from civic organizations, home -owner associations, and other interested parties, to discuss proposed revisions and amendments to the Comprehensive Plan or Land Use Plan which may directly affect them. 5. The City Clerk shall maintain the revised Comprehensive Plan, Land Use Plan, and Evaluation and Appraisal Report on file, and copies will be available to the general public for Inspection. SECTION 2 : It is the expressed Intent of this Resolu- tion to Comply with the public notice and participation requirements established by Chapter 163 Florida Statutes, and Chapter 9J-5 Florida Administrative Code. Any notice or public participation provisions required under Chapter 163 Florida Statutes and Chapter 9J-5 Florida Administratiye Code which are not expressly stated In this Resolution are hereby Incorporated by reference.
