R-88--r�Z(� A RESOLUTION AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE AN AGREEMENT WITH BROWARD COUNTY CITIZENS SAFETY COUNCIL, INC., D/B/A NATIONAL SAFETY COUNCIL, BROWARD CHAPTER PERTAINING TO CERTAIN UTILITY IMPROVEMENTS TO BE CONSTRUCTED IN CONNECTION WITH APPROVAL OF THE NATIONAL SAFETY COUNCIL SITE PLAN FOR THE PROPERTY LOCATED AT THE NORTH- EAST CORNER OF THE INTERSECTION OF PROSPECT ROAD AND NORTHWEST 21 AVENUE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Public Hearing has been held concerning an Agreement with Broward County Safety Council, Inc., d/b/a National Safety Council to determine a method for cost sharing of the water distribution system required on the National Safety Council project, located at the Northeast corner of Prospect Road and Northwest 21 Avenue, between the National Safety Council and the future developer on the site at the west of this project; and WHEREAS, notification of the Public Hearing was given to the National Safety Council as well as the property owner on the site on the west of the National Safety Council project. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the appropriate City officials are hereby authorized to execute an Agreement with Broward County Citizens Safety Council, Inc., d/b/a National Safety Council, for the property located at the Northeast corner of the intersection of Prospect Road and Northwest 21 Avenue, to determine a method for cost sharing of the water distribution system required on the National Safety Council project between the National Safety Council and the future developer of the site on the west of the National Safety Council, a copy of said agreement being attached hereto as "Exhibit 1". RICHARD DOODY CITY ATTORNEY RECORD OF COUNCIL VOTE MAYOR ABRAMOWITZ DISTRICT 1: C/M ROHR ,^ DISTRICT 2: V/M STELZER DISTRICT 3: C/M HOFFMAN DISTRICT 4- C/M BENDER , _ OA r Sg,_,;2,CZ � 19 LJ A G R E E M E N T Between CITY OF TAMARAC and _ OWARD COUNTY CITIZENS SAFETY COUNCILS INC. d b a NATIONAL SAFECOUNCIL,._TY BROWARD CHAPTER RELATING TO CERTAIN UTILITY IMPROVEMENTS TO BE CONSTRUCTED IN CONNECTION WITH APPROVAL OF THE NATIONAL SAFETY COUNCIL SITE PLAN WHEREAS, the Broward County Citizens Safety Council, Inc. d/b/a National Safety Council Broward Chapter (herein- after "NATIONAL SAFETY COUNCIL") has submitted a site plan for the property located at the northeast corner of the intersection of Prospect Road and Northwest 21 Avenue (more particularly described in Exhibit "A")= and WHEREAS, the City of Tamarac (hereinafter "CITY") has determined that the increased development occasioned by the approval of the NATIONAL SAFETY COUNCIL site plan necessi- tates the construction of certain utility improvements that will benefit an area approximately located at the northwest corner of the intersection of Prospect Road and Northwest 21st Avenue (more particularly described in Exhibit "B"); and WHEREAS, the CITY and NATIONAL SAFETY COUNCIL wish to enter into this agreement outlining the nature of, and funding for, the required utility improvementss NOW, THEREFORE, IN CONSIDERATION of the mutual terms, conditions, promises and covenants hereinafter set forth, -1- 4 CITY and NATIONAL SAFETY COUNCIL agree as follows: • v 1. That the NATIONAL SAFETY COUNCIL shall construct or have constructed the improvements (hereinafter "improve- ments"), shown on those certain Engineering drawings dated March 28.1988 and made by Keith & Schnars on behalf of the National Safety Council and as listed on file in the Engineering Office of the City of Tamarac. The improvements shall include but are not limited to: A. A 6" master meter tie-in B. A north/south 8" main from the master meter with two 8" plugs for future tie-in C. An east/west 8" main from the master meter to the east edge of the property described in exhibit "A" D. An east/west 8" main from east edge of property described in Exhibit "A" to a tie-in with the Tamarac Lakes subdivision main. 2. The parties agree that the approximate cost of the improvements is Thirty Two Thousand Seven Hundred Fifty Dollars ($32,750.00). (As shown in Exhibit "C"). 3. Further, the parties agree that the property benefited by the improvements is that property described in Exhibit "B". 4. CITY and NATIONAL SAFETY COUNCIL agree that as future developers of the benefit area (described in Exhibit "B") connect to the improvements constructed by NATIONAL SAFETY COUNCIL, the CITY shall refund to NATIONAL SAFETY COUNCIL, during the first five (5) years after the date of execution of this Agreement, pro rata shares of the . cost of the improvements as paid by subsequent -2- U • developers of the benefit area, according to the follow- 10 ing formula: a) The city will estimate total capacity (or addition- al capacity if applicable) of the facilities in gallons] (b) The volumetric load of original user will be determined by the city as a percentage of total capacity; (c) Subsequent users load will also be determined as a percentage of total capacity; (d) Such percentage will be applied to total cost of the off -site or oversized facilities to determine each user's share of costs; (e) Subsequent users share of costs will be collected by the city and remitted to NATIONAL SAFETY COUNCIL within thirty (30) days after collection; (f) No refund will exceed a developer's actual costs for off -site or oversized facilities, and in no case shall it exceed the percentage of the subsequent developer's responsibility for his volumetric load capacity; reimbursement will only take place during the five (5) years after execu- tion of this agreement providing for such reim- bursement. 5. NATIONAL SAFETY COUNCIL and CITY agree that subsequent water infrastructure required or approved by the CITY in the benefit area outlined in Exhibit "B" shall be consistent and compatible with the improvements constructed by NATIONAL SAFETY COUNCIL under this Agreement. 6. The improvements outlined in Exhibit "C" shall be bonded by NATIONAL SAFETY COUNCIL in accordance with the requirements of Section 27-50 of the Code of Ordinances of the City of Tamarac. -3- /' O I' 'PV - "P4 IN WITNESS WHEREOF, the parties hereto have made and executed this Agreement on the respective dates under each signature: City of Tamarac through its Mayor authorized to execute same by City Council action on the 411 day of l 1988 and National Safety Council, Broward Chapter signing by and through its execute same.
