BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That the appropriate City officials are
hereby authorized to execute an Agreement with Motorola
Communications and Electronics, Incorporated, in the amount
of $257,700.00 for an electronics communications system for
the Tamarac Municipal Complex/Police Facility project, a copy
of said agreement being attached hereto as "Exhibit 1".
SECTION 2: This Resolution shall become effective upon
adoption.

CONSTRUCTION AGREEMENT

hereinafter termed "Contractor" and the CITY OF TAMARAC, FLORIDA,
hereinafter termed "Owner".
WITNESSETH
WHEREAS, the Owner has awarded a contract to Contractor for performing
the work hereinafter mentioned in accordance with the Contractor's
accepted proposal:
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
I. Scope of Work. That for and in consideration of the payments and
agreements hereinafter mentioned, to be made and performed by the said
Owner, and under the conditions expressed unto attached, the said
Contractor agrees with said Owner at his own proper cost and expense,
to do all the work and furnish all the materials, except such as are
mentioned in the Contract Documents to be furnished by the Owner,
necessary to construct and complete in a good, workmanlike and
substantial manner, and to the satisfaction of the Owner for the
following work:
DISPATCH CONSOLES AND TWO-WAY RADIO SYSTEM for the TAMARAC
POLICE DEPARTMENT, Tamarac, Florida, in accordance with the Plans
and Contract Documents which are hereby specifically referred to
and by such reference made a part hereof.
2. The documents referred to in the General Requirements as "The
Contract" are hereby incorporated in and made a part of this Agreement
as if fully set forth herein. All parts of the Contract shall be
construed to be consistent with each other, including all items neces-
sary for the proper execution and completion of the work.

Documents. Notwithstanding anything to the contrary, the contract sum
provided for in this article shall not be increased except in the
manner provided in Paragraph 10 hereof.
7. Time for Performance. The said Owner hereby fixes the time for
commencement of said work to be within
days after the date of this Contract, and for its completion to be
within calendar days next after the actual date of
commencement; and further promises and agrees with the said Con-
tractor to employ, and does hereby employ the said Contractor to
provide the materials and to do the work according to the terms and
conditions herein contained and referred to, for the prices aforesaid,
and hereby contracts to pay the same at the time, in the manner and
upon the conditions above set forth; and the Owner and Contractor for
themselves, their heirs, executors, administrators, successors, and
assigns, do hereby agree to the full performance of the covenants
herein contained.
g. Payments. The Owner shall make payments on account of the
contract as provided herein as follows:
(A) An amount equivalent to go% of the cost of equipment delivered
to the site and work accomplished during any given month shall be paid
to the Contractor within thirty (30) days after presentation of
billing to the City.
(B) After completion and final acceptance of Work by the Owner and
the Architect, and upon delivery by the Contractor to the Owner the
labor and material release or waiver, receipts, affidavits, record
drawings and warranties required by the General Requirements, the
Contractor shall be entitled to the final ten percent (10%) due, 35
days after the date of substantial completion, providing no liens or
claims have been filed.
9. Contractor's Duties and Status. The Contractor agrees to furnish
the Owner his best skill and judgment and to cooperate with the Owner.
The Contractor agrees to furnish efficient business administration and
job superintendence, and to keep upon the work at all times an
adequate supply of workmen and materials.

14. Understanding of Parties. This Agreement expresses the entire
understanding and agreements of the parties with respect to this
project and supersedes and cancels any and all prior contracts or
agreements between the parties.
