R-88- --3D S A RESOLUTION OF THE CITY OF TAMARAC GRANTING APPROVAL OF A CARNIVAL SPONSORED BY TAMARAC POLICE ATHLETIC LEAGUE AND TAMARAC KIWANIS CLUB ON WEDNESDAY, NOVEMBER 23, THRU SUNDAY, NOVEMBER 27, 1988, LOCATED ON UNIVERSITY DRIVE SOUTHEAST CORNER OF 78TH STREET, ACROSS FROM TAMARAC ELEMENTARY SCHOOL, CONTINGENT UPON APPROVAL AND EXECUTION OF A HOLD HARMLESS AGREEMENT, PROVIDING FOR WAIVER OF ALL APPROPRIATE FEES; PROVIDING THE REQUIRED BUILDING PERMITS ARE OBTAINED; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Tamarac has received a request from Tamarac Police Athletic League and Tamarac Kiwanis Club to operate a carnival from Wednesday, November 23, thru Sunday, November 27, 1988, on property located on University Drive southeast corner of 78th Street, across from Tamarac Elementary School; and WHEREAS, Tamarac Police Athletic League and Tamarac Kiwanis Club are non-profit organizations, and request waiver of building permit fees; and WHEREAS, the Tamarac Police Athletic League and Tamarac Kiwanis Club have requested to be able to sell beer at the carnival, showing evidence of State approval of a 4COP License, as shown on Exhibit "A"; and WHEREAS, the Tamarac Police Athletic League and Tamarac Kiwanis Club have agreed to hold the City harmless of any claims whatsoever arising from the location, construction, * installation and operation of a carnival. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: * SECTION 1: That the approval of the carnival by the City is subject to an executed Hold Harmless Agreement, as shown on Exhibit "B". SECTION 2: Building permit fees shall be waived but the waiving of building permit fees shall not eliminate the requirement to have regulatory agency inspections. n 1 in Temp. SECTION 4: That the selling of beer is subject to regulations of the State of Florida Department of Business Regulations, Division of Alcoholic Beverages and Tobacco for Temporary 4COP License. SECTION 5: That cleanup of the property is to be provided by the Tamarac Police Athletic League and Tamarac Kiwanis Club and said cleanup shall be continuous during carnival time period of Wednesday, November 23, thru Sunday, November 27, 1988. SECTION 6: That proper insurance coverage be provided in connection with the operation of said carnival.
