R-88-�3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA RELATING TO A PERSONNEL HEARING HELD PURSUANT TO SECTION.52.02 OF THE CITY OF TAMARAC PERSONNEL MANUAL,'PROVIDING FOR ADMINISTRATIVE SUBPOENAS ISSUED PURSUANT TO RESOLUTION R-88-285; PROVIDING THAT THE PARTY REQUESTING THE SUBPOENAS SHALL BE REQUIRED TO SERVE THE SUBJECT SUBPOENAS; PROVIDING THAT THE PARTY REQUESTING THE SUBPOENAS SHALL HAVE THE RESPONSIBILITY OF ENFORCING THE SUBPOENAS IF THEY ARE NOT COMPLIED WITH; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Resolution R--88-285 provides that upon the request of an appropriate party the City Council of the City of Tamarac may issue subpoenas compelling the attendance of necessary witnesses for personnel hearings held pursuant to Section 52.02 of the City of Tamarac Personnel Manual; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC: SECTION 1: That appropriate subpoenas shall be drafted compelling the attendance of the witnesses named in Exhibit A attached hereto to attend the Personnel hearing to be held in the matter concerning John F. Montalvo, Jr. to be held on November 22, 1988 starting at 9:00 A.M., in Conference Room #1 of the City of Tamarac City Hall. SECTION 2: That the party requesting the subpoenas, John F. Montalvo, Jr., shall be required to serve the subject subpoenas and shall do so at his own expense. Appropriate expenses incurred by witnesses called pursuant to this resolution shall be the responsibility of John Montalvo, Jr. as the party who has requested the subpoenas issued herein. -1- ■ Temp. Reso. 45235 1 2 3 4 SECTION 3: That, if the subject subpoenas are not com- plied with, that it shall be the responsibility of the re- questing party, John F. Montalvo, Jr., to enforce the sub- poenas pursuant to Resolution R--88-285. Section l(k) of Resolution R-88--285 provides that the requesting party is hereby authorized to seek enforcement of a subpoena by filing a petition for enforcement in the Circuit Court of the Judicial Circuit in which the person failing to comply with the subpoena resides. SECTION 4: That the City Clerk is hereby authorized to sign the subpoenas issued pursuant to this Resolution on behalf of the presiding officer of the City Council of the City of Tamarac. SECTION 5: That, for purposes of determining legisla- tive intent, it is the express intention of the City Council of the City of Tamarac that this Resolution shall be read in conjunction with and supplement to, prior Resolution R-88-285.
