R-88-- � 6 A RESOLUTION GRANTING A LIMITED WAIVER OF PARKING ' REQUESTED BY J. LADD HOWELL AT COMMERCIAL OFFICE VILLAS, SOUTHWEST CORNER OF COMMERCIAL BOULEVARD BETWEEN N.W. 47 TERRACE AND THE FLORIDA TURNPIKE, 8 PETITION #28-Z-88; AND PROVIDING AN EFFECTIVE DATE. 9 10 WHEREAS, Chapter 18 of the Tamarac City Code provides that the City Council may grant a limited waiver of the off- 12 11 street parking and loading requirements whenever a hardship 13 would exist by adhering to strict application thereof, and further provides that the waiver would not be detrimental to 14 15 public safety, health and welfare of the citizens of the City; and 16 17 WHEREAS, a hardship exists at Commercial Office Villas, southwest corner of Commercial Boulevard between N.W. 47 18 Terrace and the Florida Turnpike; and WHEREAS, the Planning Commission has held a public hearing thereon and has recommended approval of this 21 application; and 22 WHEREAS, the City Council desires to take action on the 23 limited waiver requested in the application of J. Ladd 24 Howell, Petition #28-Z-88. 25 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 26 TAMARAC, FLORIDA: 27 SECTION 1: That the application by J. Ladd Howell to 28 permit a parking waiver for the following areas: 29 1) Parking requirements for driveways as provided in 30 Section 18-4(5)(A) stating that all parking aisles shall connect to a driveway. 2) Parking requirements for fire lanes under Section 18-4(13) which states a fire lane, a minimum of twenty (20) feet wide, shall be provided to service all structures that do not abut directly onto a public 33 street or roadway. 3) Parking requirements concerning fire apparatus as 34 provided in Section 18-4(12) which states all buildings and structures, other than single-family or duplex 35 residences shall have one side of the building, in addition to the front, accessible to fire apparatus. 1 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 Arm 18 `68 22 23 24 25 26 27 28 29 30 091 34 35 Temp. Reso. #5273 4) Parking requirements for functional elements of on -site circulation system as provided in Section 18-4(3) which states car parking stalls, parking aisles, driveways, reservoir areas and entrances are the basic functional elements of the on --site circulation system. is HEREBY APPROVED, and such limited waiver would not be detrimental to the public safety, health and welfare of the citizens of the City.
