R-88-2�— A RESOLUTION ISSUING DEVELOPMENT ORDER NO. 234 FOR VISUAL GRAPHICS PARK FOR FERGUSON PLUMBING/CLAIRSON MANUFACTURING PROJECT FOR A REVISED SITE PLAN PURSUANT TO THE PROVISIONS OF SECTIONS 7-2 THROUGH 7-11 OF THE TAMARAC CODE; AND PROVIDING AN EEE_CT IYE_D-�E-1 - WHEREAS, pursuant to the instructions of the City Council of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a development order by the applicant for development approval; and WHEREAS, the City Council reviewed the development order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the application is in compliance with all elements of the Comprehensive Plan, or, will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC; FLORIDA: SECTION Ai That, the application for approval of a revised site plan for Visual Graphics Park, prepared by Architect John Evans, revised on February 25, 1988, reflecting the addition of Ferguson Plumbing/Clairson Manufacturing, is HEREBY APPROVED subject to the following conditions: A. Reso. #4972 Revised 3/10/88 B. Commencement of construction shall be no longer than one year from the date of this approval. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the revised development order are set forth as follows: 1. The Engineering, Fire Department and Building Department must be satisfied that all codes are upheld and some system set up for water, fire department and potable water. The issuance of Certificates of Occupancy are solely the province of plans, inspections and approval of Building and Fire Departments as administrators of the SFBC. 2. Fire lanes to be posted and striped per City Code. 3. Reflectorized pavement markings to be installed per Tamarac Fire Department and Tamarac Utilities West specifications. 4. Sprinkler system to comply with NFPA 13 and/or 231C and be verified prior to CO issuance. 5. All developments shall have available a public fire protection water supply system. 6. See attached memo dated 2/19/88 from Director of Utilities/Engineering. 7. An overall landscape plan shall be submitted to the City within ninety (90) days; however no Certificate of Occupancy shall be issued until a landscape plan has been approved by the City. SECTION 2; Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. Greenwood, Director of Utilities/Engineering SUBJECT: VISUAL GRAPHICS - SITE PLAN APPROVAL DATE: February 19, 1988 COPIES: On reviewing the two (2) drawings for the Ferguson and Clairson Projects that are being proposed for the Visual Graphics site, the curb cuts and turning lanes must be removed from the proposed Site Plans before being submitted to Council. Attached are meeting/field report from DeRose and Slope for meetings held on February 9, 1988 and February 10, 1988. These reports have been marked with Engineering comments. Please note that the Lake Maintenance Easement dedication and Public Safety Easement dedication listed under I and 2 of the report or meeting of February 9, 1988 was not received until February 18, 1988. These documents have been re -written and will have to be reviewed in detail by Engineering and by the City Attorney.
