CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-88-f6
A RESOLUTION AUTHORIZING THE TAMARAC KIWANIS
CLUB TO SELL BEER AT BOTH THE CELEBRITY
SOFTBALL GAME TO BE HELD ON SUNDAY, JUNE 19,
1988, AT THE CITY OF TAMARAC PARK ON UNIVER-
SITY DRIVE AND AT THE CITY STREET FAIR, TO BE
HELD ON SATURDAY, JUNE 18, 1988 AND SUNDAY,
JUNE 19, 1988, ON NORTHWEST 57TH STREET;
PROVIDING THE HOURS WITHIN WHICH BEER MAY BE
SOLD; PROVIDING THAT THE AUTHORIZATION TO
SELL BEER IS CONTINGENT UPON THE EXECUTION OF
A HOLD HARMLESS AGREEMENT; THAT THE TAMARAC
KIWANIS CLUB HAS VOLUNTEERED TO DONATE THE
NET PROCEEDS RECEIVED FROM THE CONCESSION TO
THE CITY'S PARK AND RECREATION DEPARTMENT;
PROVIDING FOR THE WAIVER OF ALL APPROPRIATE
FEES REQUIRED UNDER THIS RESOLUTION; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, 1988 is the 25th anniversary of the incorpora-
tion of the City of Tamarac, Florida; and
WHEREAS, the Tamarac Kiwanis Club wishes to acknowledge
the City's anniversary by hosting a Celebrity Softball game
as part of the anniversary celebration; and
WHEREAS, under Section. 18A-7(d) of the City of Tamarac
Code of Ordinances the City has the power to regulate the
sale of food and drink in the City's parks; and
WHEREAS, Section 18A-5(a) of the City Code permits the
consumption and possession of alcoholic beverages at group
functions in City parks provided a permit for such consump-
tion. is obtained,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1 That the City Council authorizes the
Tamarac Kiwanis Club to sell beer on Sunday, June 1.9, 1988,
after 12:00 noon, at the Tamarac Park on University Drive.
The selling of beer will end approximately thirty (30)
minutes after completion of the Softball game, however in no
event shall the sale of beer extend beyond the hour of
5:00 PM.

SECTION 2 : That the City Council also authorizes the
Tamarac Kiwanis Club to sell beer at the City street fair, to
be held on both Saturday, June 18, 1988 and Sunday, June 19,
1988, on Northwest 57th Street. The hours of sale will be
from 12:00 noon to 10:00 PM on Saturday, June 18, 1988, and
from 12:00 noon to 5:00 PM on Sunday, June 19, 1988.
SECTION 3 The Tamarac Kiwanis Club has volunteered
and agreed that all net proceeds received from beer sales at
the Softball game and the City street fair, minus expenses,
will be donated to the City of Tamarac Parks and Recreation
Department.
SECTION 4 : That the approval of the sale of beer
authorized herein is contingent upon the City receiving a
hold harmless agreement from the Tamarac Kiwanis Club and/or
the beer distributor for any claim or act which may arise as
a result of the activities permitted by this Resolution.
SECTION 5 : The City Council waives all appropriate
fees required under this Resolution.
SECTION 6 This Resolution shall become effective
immediately upon its passage.
