R--87- /e�2I A RESOLUTION ISSUING AUTO CARE DEVELOPMENT ORDER NO. 219 FOR A FINAL SITE PLAN PURSUANT TO PRO- VISIONS OF SECTION 7-2 THRU 7--11 OF THE TAMARAC CODE, AND PROVIDING AN EFFECTIVE DATE. 7 WHEREAS, pursuant to the instructions of the City B Council of Tamarac, Florida, a public meeting has been 9 advertised in accordance with applicable law of the date, 10 time and place of the meeting regarding the review of the 11 application for a development order by the applicant for 22 development approval; and 13 WHEREAS, the City Council has examined and ivestigated 14 the application, staff and Planning Commission recommenda-- 15 tions and the attached Development Review Status Sheet dated 16 4/8/87; and 17 WHEREAS, the City Council reviewed the development order tand accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the Z0 application is in compliance with all elements of the Compre- 21 hensive Plan, or will be in compliance prior to the issuance 22 of a Certificate of Occupancy for the development that is the 23 subject of the application. 24 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 25 TAMARAC, FLORIDA: 26 SECTION 1: That the development described on the 27 attached development review status sheet dated 4/8/87 is 28 granted a development order to proceed subject to the follow- 29 ing conditions: f330 A. Construction is to be in complete compliance with 1 the plans and specifications submitted by the developer to .32 the City of Tamarac as described in Section II of the 33 Development Review Status Sheet and approved engineering 34 drawings. 35 36 1 Temp. Commencement of construction shall be no longer than one year from the date of this approval. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The development order is assignable, but an assign- ment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the development order are set forth as follows: 1. The reduction of the required 20-foot landscaped berm on Commercial Blvd. to 17-feet is hereby approved. SECTION 2: That the following documents are hereby accepted and approved as a part of this development order: A. Water and Sewer Developer's Agreement. B. Tamarac Utilities East Utility Easement. C. Public Safety Ingress/Egress Easement. D. Water Retention Agreement. SECTION 3: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether -the approval shall be null and void.
