R-87- 3 A RESOLUTION ISSUING JASMINE (WOODMONT TRACTS 4 68/77) REVISED DEVELOPMENT ORDER NO. 155-1 FOR A REVISED SITE PLAN FOR UPGRADE OF UNITS, 5 ADDITION OF GARAGES (BLDGS. 12-27) AND REDUCTION OF TOTAL NUMBER OF UNITS PURSUANT TO PROVISIONS OF SECTION 7-2 THRU 7-11 OF THE TAMARAC CODE; AND PROVIDING AN EFFECTIVE i DATE. 6 WHEREAS, pursuant to the instructions of the City 9 Council of Tamarac, Florida, a public meeting has been 10 advertised in accordance with applicable law of the date, 11 time and place of the meeting regarding the review of the 12 application for a revised development order by the applicant 13 for development approval; and 14 WHEREAS, the City Council has examined and investigated 15 the application, staff and Planning Commission recommen- 16 dations and the attached Development Review Status Sheet 17 dated 4/8/87; and g WHEREAS, the City Council reviewed the revised develop- g ment order and accompanying documents at a public 20 meeting; and 21 WHEREAS, the City Council has determined that the 22 application is in compliance with all elements of the 23 Comprehensive Plan, or will be in compliance prior to the 24 _issuance of a Certificate of Occupancy for the development 25 that is the subject of the application. 26 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 27 TAMARAC, FLORIDA: 28SECTION 1: That the application for approval of a 29 revised site plan for Jasmine (Woodmont Tracts 68/77) revised 30 on March 26, 1987 by Craven Thompson & Assoc., Inc. to 31 reflect upgrade of units, addition of garages (Bldgs. 12-27) 32 and reduction of total number of units is approved subject to 33 the following conditions: 34 35 36 1 1 2 3 4 5 Li 8 9 10 11 12 13 14 15 26 17 20 21 22 23 24 25 26 27 28 29 71 32 33 34 35 36 Temp. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City.of 'Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. B. Commencement of construction shall be no longer than one year from the date of this approval. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with.applicable regulations. C. The revised development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the revised development order are set forth as follows: No NE SECTION 2: That the following documents are hereby accepted and approved as a part of this development order: NoNC SECTION 3_ Should any section or provision of this revised development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. a.CTION4: This revised development order as condi- tioned shall become effective immediately upon its passage.
