R-87- 4.7-9 A RESOLUTION APPROVING AND AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE A FOURTH AMENDMENT TO THE INTERLOCAL AGREEMENT BETWEEN THE CITY OF TAMARAC AND BROWARD COUNTY, PERTAINING TO DISTRIBUTION OF THE PROCEEDS OF THE LOCAL OPTION GAS TAX IMPOSED BY THE BROWARD COUNTY LOCAL OPTION GAS TAX ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the City Council of the City of Tamarac hereby approves the Fourth Amendment to the Agreement between the City of Tamarac and Broward County (attached hereto and made a part hereof as Exhibit "A") pertaining to distribution of the proceeds of the local option gas tax imposed by the Broward County local option gas tax ordinance; SECTION 2: That the appropriate City Officials are hereby authorized to execute said Amendment. YANT MR MAYOR: HART DIST. 1: C/M ROHR —_ '-IST. 2: C/M STELZER DST. 3: C/M HOFFMAN 67 LIST. 4: V/M STEIN i r 0 FOURTH AMENDMENT TO INTERLOCAL AGREEMENT Between BROWARD COUNTY And CITY OF TAMARAC Providing for DIVISION AND DISTRIBUTION OF THE PROCEEDS OF THE LOCAL OPTION GAS TAX IMPOSED BY THE BROWARD COUNTY LOCAL OPTION GAS TAX ORDINANCE EXHIBIT "A" 0 FOURTH AMENDMENT TO INTERLOCAL AGREEMENT Between 40 BROWARD COUNTY And CITY OF TAMARAC Providing for DIVISION AND DISTRIBUTION OF THE PROCEEDS OF THE LOCAL OPTION GAS TAX IMPOSED BY THE BROWARD COUNTY LOCAL OPTION GAS TAX ORDINANCE This is the Fourth Amendment to the Interlocal Agreement, made and entered into by and between: BROWARD COUNTY, a political subdivision of the State of Florida, hereinafter referred to as "COUNTY," and CITY OF TAMARAC, a municipal corporation, existing under the laws of the State of Florida, hereinafter referred to as "CITY," WHEREAS, Section 336.025 (1) (d) , Florida Statutes (1986 Supp .) , authorizes the counties to extend the levy of the additional fifth (5th) . cent and sixth (6th) cent local option gas tax upon every gallon of motor fuel and special fuel sold in Broward County from year to year on a majority vote of the governing body of the COUNTY; and WHEREAS, prior to July 1, 1987, the Board of County Commissioners will consider enactment of an ordinance to be effective September 1, 1987, through August 31, 1988, pursuant to said enabling legislation, extending the levy of said additional fifth (5th) and sixth (6th) cent local option gas tax; and WHEREAS, Section 336.025(3)(a), Florida Statutes (1986 Supp.), requires such ordinance to provide for a method of distribution of the proceeds of this tax; and WHEREAS, one such method is the execution of an interlocal agree- ment, with one or more of the municipalities representing a majority of the population of the incorporated area within the county which establishes the distribution formulas for dividing the proceeds of the tax among the county F, 1 LJ 0 and all eligible municipalities within the county prior to July 1, as set forth in Section 336.025 (3) (a)1 . , Florida Statutes (1986 Supp.) ; and WHEREAS, the parties hereto have agreed to apply the distribution formula existing under the terms of said Interlocal Agreement and the Addendum thereto to such additional fifth (5th) cent and sixth (6th) cent local option gas tax for the extension of said tax through August 31, 1988; and WHEREAS, paragraph 4 of the Interlocal Agreement, as amended by the Addendum to the Interlocal Agreement, requires annual adjustment of the population of the individual municipalities and unincorporated Broward County in accordance with the population figures set forth in the most current edition of "Florida Estimates of Population," published by the Bureau of Economics and Business Research, Population Division, University of Florida; NOW, THEREFORE, IN CONSIDERATION of the mutual terms, conditions, promises, covenants and premises set forth herein, the COUNTY and the CITY agree as follows: 1. Paragraph 2 of said Interlocal Agreement, as amended, is further amended to read as follows: 2. In accordance with the population figures set forth in the most current edition of "Florida Estimates of Population," published by the Bureau of Economics and Business Research, Population Division, University of Florida, paragraph 3 of said Interlocal Agreement, as amended by the Addendum thereto and the Seeotrd Third Amend- ment to the Interiocal Agreement, is amended as follows: 3. The parties to this Amendment expressly agree that should the Board of County Commissioners enact an ordinance providing for a one-year extension of the levy of the additional fifth (5th) and sixth (6th) cent local option gas tax pursuant to Section 336.025, Florida Statutes (1986 Supp.), upon every gallon of motor fuel and special fuel sold in Broward County and taxes under the provisions of Chapter 206, Florida Statutes, prior to July 1, 1987, to be effective September 1, 1987, through August 31, 1988, that the distribution formula for said additional two (2) cents shall be the same as the formula applied to the four (4) cent local option gas tax set forth in the Interlocal Agreement as amended herein. 4. All provisions of said Interlocal Agreement, as amended, and the Addendum thereto, as amended, not in conflict with this Amendment shall remain in full force and effect. S. This Amendment is made a part of said Interlocal Agreement and Addendum thereto. 6. This Amendment shall become effective on the date last executed by the parties hereto provided that those eligible municipalities representing a majority of the incorporated area population have executed this Amendment prior to June 1, 1987. 7. This Amendment may be simultaneously executed in several counterparts, each of which so executed shall be deemed to be an original, and such counterparts together shall constitute one and the . same instrument.
