A RESOLUTION OF THE CITY OF TAMARAC, FLORIDA URGING GOVERNOR BOB MARTINEZ TO SIGN HB 1336 WHICH CONCERNS MEETINGS OF PUBLIC BODIES TO DISCUSS PENDING LITIGATION; AND PROVIDING AN EFFECTIVE DATE, WHEREAS, Florida's municipalities and other public bodies operate at a disadvantage by having to discuss litigation strategy and possible settlements of pending lawsuits in the "sunshine" but the opposing parties are not subject to the same constraints and exposure; and WHEREAS, it is not in the public interest to continue to impose this requirement on public bodies; and WHEREAS, the Florida Legislature has addressed the problem by passing HB 1336 as a solution thereto; and WHEREAS, HB 1336 requires that the closed public meeting be taped and that the tape be released at the conclusion of the litigation; and WHEREAS, local governments are involved in numerous emergency hearings in which local government attorneys do not have the time to advise councilmembers on an individual basis; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 The City Council of the City of Tamarac, Florida hereby urges the Honorable Bob Martinez, Governor, to sign HB 1336 into law. SECTION 2 That the appropriate staff ensure that a certified copy of this Resolution is forwarded to the Governor's office in an expeditious manner.
