A RESOLUTION APPROVING AND ACCEPTING A
RIGHT OF WAY DEED OFFERED BY RICHARD C.
JONES, TRUSTEE, UNDER TRUST NUMBER SECTION 7
DATED SEPTEMBER 14, 1973, FOR THE NOB HILL
ROAD PROJECT 85-23; AND PROVIDING AN
EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That the Right of Way deed offered by
Richard C. Jones, Trustee, under Trust number section 7 dated
September 14, 1973, for the Nob Hill Road Project 85-23 is
HEREBY APPROVED and accepted, a copy of said deed being
attached hereto as "Exhibit 1".
3ECTTD_V 2: That the City Clerk is hereby authorized and
directed to record said deed in the public records of Broward
County, Florida.
SECTION 3: This Resolution shall become effective upon
adoption.

RIGHT--OF-WAY DEED
THIS RIGHT-OF-WAY DEED, executed this day of
1r_1_ , 1987, by RICHARD C. JONES, Trustee, ("Grantor")
under Trust Number Section 7 dated September 14, 1973, and not
personally, to the CITY OF TAMARAC, a municipal corporation of
the State of Florida, whose address is 5811 N.W. 89th Avenue,
Tamarac, Florida 33321, its successors and assigns, ("Grantee").
W I T N E S S E T H:
That Grantor, for and in consideration of the sum of TEN
AND NO/100---------- ($10.00)---------- DOLLARS in hand paid by
the Grantee and other good and valuable consideration, the receipt
whereof is hereby acknowledged, does hereby remise, release and
quit -claim unto the Grantee for public roadway and other
appropriate purposes incidental thereto, all the right, title,
interest, claim and demand which the Grantor has in and to the
following described lot, piece or parcel of land situate, lying
and being in the County of Broward, State of Florida, ("Property")
to wit:
See Exhibit "A" attached hereto and incorporated herein
by reference,
SUBJECT TO:
1. Real property taxes for the year 1987 and subsequent
years.
2. Covenants, agreements, conditions, easements and
restrictions of record.
3. A reservation unto the Grantor as follows:
Grantor, its successors and assigns, reserve all
rights not herein granted pursuant to this Easement
including, but not limited to, the right of ingress
and egress over and upon the Easement Property, the
right to run utility lines under the Easement Property;
provided always, however, any such use of the Easement
Property pursuant to the rights reserved hereunder
or pursuant to any such subsequently granted easements
shall not unreasonably interfere with the use of the
Easement Property for the purpose herein set forth.
Together
with
all the
tenements,
hereditaments and
appurtenances
thereto
belonging or
in anywise
appertaining.
TO HAVE AND TO HOLD, the same in fee simple forever.
And the Grantor hereby covenants with said Grantee that
it is lawfully seized of said land in fee simple; that it has
good right and lawful authority to sell and convey said land;
that it hereby fully warrants the title to said land and will
defend the same against the lawful claims of all persons claiming
by, through or under the said Grantor.
This deed is executed by Grantor not individually or
personally, but solely as Trustee in the exercise of the power
and authority conferred to him as Trustee, and it is expressly
understood and agreed that nothing contained herein shall be
construed as creating any liability on the Trustee personally
to perform any covenant, undertaking, representation or agreement,
either express or implied, contained herein, all such liability
of the Trustee, if any, being expressly waived by the Grantees;
so far as such Trustee personally is concerned, the Grantees
shall look solely to the real estate described in Exhibit "A"
for the payment or performance of any undertaking, representation,
agreement or covenant, either express or implied, contained herein.
IN WITNESS WHEREOF, the Grantor has signed and sealed these
presents the day and year first above written.
