RESOLUTION NO. R-87- ,,2--/4=
A RESOLUTION APPROVING AND ACCEPTING A
30-FOOT DRAINAGE EASEMENT OFFERED BY
LEADERSHIP HOUSING, INC. FOR THE NOB HILL
ROAD PROJECT 85-23; AND PROVIDING AN
EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the 30-foot drainage easement offered by
Leadership Housing, Inc. for the Nob Hill Road Project
85-23 is HEREBY APPROVED and accepted, a copy of said easement
- being attached hereto as "Exhibit 111.
SECTION 2: That the appropriate City officials are
hereby authorized to execute said easement on behalf of the
City.
,SECT ON 3: That the City Clerk is hereby authorized and
directed to record said easement in the public records of
Broward County, Florida.
SECTION 4: This Resolution shall become effective upon
adoption.

DRAINAGE EASEMENT
THIS DRAINAGE EASEMENT made this AL/ day of ,
1987, by LEADERSHIP HOUSING, INC., a Delaware corporation
authorized to do business in the State of Florida ("Grantor")
and the CITY OF TAMARAC, a Florida. municipal corporation having
an address at 5811 Northwest 88th Avenue, Tamarac, Florida 33321,
("Grantee").
(Whenever used herein, the term "Grantor" and "Grantee" shall
include the respective successors and assigns of the parties
hereto, whenever the context so admits or requires).
W I T N E S S E T H
WHEREAS, Grantor is the owner of that certain real property
located in Broward County, more particularly described in Exhibit
"A" attached hereto, (hereinafter referred to as the "Easement
Property") and
WHEREAS, Grantor desires to grant unto Grantee a
non-exclusive easement to use the Easement Property;
NOW, THEREFORE, in consideration of the sum of TEN DOLLARS
($10.00) and other good and valuable considerations paid by
each of the parties hereto to the other party, receipt of which
is hereby acknowledged by both parties, the parties hereto do
hereby grant and agree as follows:
1. Grantor hereby grants and conveys to Grantee, its
successors and assigns, a non-exclusive easement on, over, under
and upon the Easement Property for the underground installation
and maintenance of drainage facilities.
10 2. Grantor reserves all rights not herein granted pursuant
to this easement, including but not limited to, the right of
free ingress and egress over and upon the Easement Property,
to build roads across the Easement Property, to run utility
lines over or under the Easement Property, to construct
improvements or install landscaping upon the Easement Property,
use the Easement Property as open space and to grant further
easements under, over and on the Easement Property; provided
that, in no event shall any of the rights herein reserved impede
the easement herein granted or the exercise of the rights of
use thereunder.
3. Grantor reserves the right at any time to relocate
all or any portion of the drainage facilities to an alternative
location and to modify this Drainage Easement provided that,
in no event shall the exercise of this right impede the easement
herein granted or the exercise of the rights of use thereunder.
Any such relocation shall be evidenced by a supplemental drainage
easement for the installation and maintenance of drainage
facilities ("Supplemental Drainage Easement") executed by Grantor
and placed amongst the Public Records of Broward County, Florida.
The Supplemental Drainage Easement shall specifically describe
any portions of the Easement Property which is no longer to
be subject to the Drainage Easement ("Deleted Easement Property").
Upon recording of the Supplemental Drainage.Easement, the Drainage
Easement shall terminate as to the Deleted Easement Property.
The Supplemental Drainage Easement shall further specifically
describe any additional land owned by Grantor to be subject
to the Drainage Easement which were not previously described
herein as within the Easement Property ("Supplemental Easement
Property"). Upon recording of the Supplemental Drainage Easement,
the Supplemental Easement Property shall be included within
the Easement Property and be subject to the terms and conditions
of this Drainage Easement.

4. The provisions of this easement shall be binding on
the parties hereto and the respective successors and assigns
as a covenant running with and binding upon the Easement Property.
5. This easement shall not be released or altered without
consent of the Grantee.
