R--87- r G A RESOLUTION APPROVING AND ACCEPTING AN 18--FOOT RIGHT OF WAY EASEMENT OFFERED BY MINI MART DE- VELOPMENT CORP.; FOR THE NOB HILL ROAD PROJECT 85-23; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the 18-foot Right of Way easement offered by Mini Mart Development Corp. for the Nob Hill Road Project 85-23 is HEREBY APPROVED and accepted, a copy of said easement being attached hereto as "Exhibit 1". SECTION 2:- That the appropriate City officials are hereby authorized to execute said easement of behalf of the City. ECTION 3: That the City Clerk is hereby authorized and directed to record said easement in the public records of Broward County, Florida. SECTION 4: This Resolution shall become effective immediately upon adoption. PASSED, ADOPTED AND APPROVED this day of r , 1987. ATTEST: CAROL E. WHREAS, the Grantor is the owner of property situate in Broward County, Florida and described as follows: See Attached Exhibit "A" WHEREAS, the Grantor desires an easement for a public road and/or other appropriate purposes incidental thereto, on, over and across said property, and WHEREAS, the Grantor is willing to grant such easement, NOW, THEREFORE, for and in consideration of the mutual covenants each to the other running and one dollar and other good and valuable considerations, the Grantor does hereby grant unto the Grantee, its successors and assigns, full and free right and authority to construct, maintain, repair, install and rebuild facilities; for above stated purposes and does hereby grant a perpetual easement on, over, and across the above described property for said purposes subject to the following conditions: a. That within one (1) year of the acceptance of this easement by the Grantee, Grantee will zone Grantor's property which is described in Exhibit "B" attached hereto to the City of Tamarac's Industrial zoning district. Provided, however, that if the property described in Exhibit "B" is not zoned as provided herein, this easement and all rights granted hereunder shall revert to the Grantor, its successors and/or assigns. b. This easement and all rights granted hereunder shall revert to the Grantor, its successor and/or assigns, if the property which is the subject of this easement is not utilizied for public purposes within five (5) years of the date of Grantees' execution of this easement.
