R-87-EZ5 2 A.RESOLUTION ISSUING MIDWAY PLAZA 3 REVISED DEVELOPMENT ORDER NO. 123•-1 FOR A REVISED SITE PLAN FOR REVISED 4 PARKING AND BUILDINGS ON OUTLOTS PURSUANT TO PROVISIONS OF SECTION 7-2 THRU 7-11 OF THE TAMARAC CODE; AND PEDYIDING AN EFFECTIYN DATE, 7 WHEREAS, pursuant to the instructions of the City B Council of Tamarac, Florida, a public meeting has been 9 advertised in accordance with applicable law of the date, 10 time and place of. the meeting regarding the review of the 11 application for a revised development order by the applicant 12 for development approval; and 13 WHEREAS, the City Council has examined and investigated 14 the application, staff and Planning Commission recommen- dations and the attached Development Review Status Sheet 35 dated January 15, 1987; and 16 WHEREAS, the City Council reviewed the revised 17 development order and accompanying documents at a public 8 meeting; and 19 WHEREAS, the City Council has determined that the appli- 20 cation is in compliance with all elements of the Compre- 21 hensive Plan, or will be in compliance prior to the issuance 22 of a Certificate of Occupancy for the development that is the 23 subject of the application. 24 25 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: 26 27 SECTIQN 1: That the development described on the 29 attached development review status sheet dated January 15, 29 1987 is granted a revised development order to proceed 30 subject to the following conditions: 31 A. Construction is to be in complete compliance with 32 the plans and specifications submitted by the developer to 33 the City of Tamarac as described in Section II of the 34 Development Review Status Sheet and approved engineering 35 drawings. 36 -1- Temp. Reso. #4476 1 2 3 B. Commencement of construction shall be no longer 4 than one year from the date of this approval. If the development does not commence construction within one year, 7 this approval is null and void unless an extension has been B granted in accordance with applicable regulations. 9 C. The revised development order is assignable, but an 10 assignment does not discharge any assignee from strict 11 compliance with the order unless the City Council consents to 12 modify any of the original requirements. 13 D. Additional conditions established in order to issue 14 the revised development order are set forth as follows: 1. Installation of Automatic Fire Sprinkler System IS Per NFPA #13. 16 17 2. Developer to submit fire flow calculations for each proposed building. 8 R9 3. Council approval of Limited Waiver #28-Z-86 for 20 112 ninety (90) degree parking right angle parking spaces. 21 22 23 24 SECTION 2: That the following documents are hereby accepted and approved as a part of this development order: 25 26 AJO AJ 6 27 SECTION 3: Should any section or provision of this 28 revised development order be declared by a court of competent 29 jurisdiction to be invalid, the City Council shall determine 30 if the other portions of the order remain valid or whether 31 the approval shall be null and void. 32 33 34 35 36 -2- Temp.
