R-87 A.RESOLUTION ISSUING DEVELOPMENT ORDER NO. 214 FOR A REVISED SITE PLAN FOR FENCE ALONG NW 53 STREET PURSUANT TO PROVISIONS OF SECTION 7-2 THRU 7-11 OF THE TAMARAC CODE; AND PROVIDING AN EFFEC- TIVE DATE. WHEREAS, pursuant to the instructions of the City Council of Tamarac, Florida,. a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommen- dations and the attached Development Review Status Sheet dated January 15, 1987; and WHEREAS, the City Council reviewed the development order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the appli- cation is in compliance with all elements of the Compre- hensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION _1: That the development described on the attached development review status sheet dated January 15, 1987 is granted a development order to proceed subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. -1- Temp. Commencement of construction shall be no longer than one year from the date of this approval. If the development.does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue thre development order are set forth as follows: ') b /V E I 2: That the following documents are hereby accepted and applied as a part of this development order: SECTION 3: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. Adoption of Development Order / 214 Master File 1 7-81 For: TAMARAC LAKES NORTH REVISED SITE PLAN FOR FENCE ALONG NW 53 St. Project subject to the requirments included in the Report and the following conditions: Tamarac Lakes North Association requested an approval from the committee for a revised site plan for a fence along their west property line and along the north line of their section which is also the south right of way line of NW 53 St. The committee did grant the western fence, but denied the fence along NW 53 St. They are appealing this decision before Council.
