R-87-�� A RESOLUTION AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE A SECOND ADDENDUM TO THE BUS SHELTER . AGREEMENT WITH PUBLIC ADVERTISING, INCORPORATED; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the appropriate City Officials are hereby authorized to execute a Second Addendum to the Bus Shelter Agreement with Public Advertising, Incorporated, for erecting and maintaining bus stop shelters within the City, a copy of said Second Addendum being attached hereto as Exhibit "in, j$E-CTJON__ 2: This Resolution shall become effective immediately upon adoption. ram` PASSED, ADOPTED AND APPROVED this,23 day of , 1987. W I T N B S S E T 8• WHEREAS, the parties have entered into a Bus Shelter Agreement on the =d ay of , 1987; and Addendum thereto on the day of , 1987, and, WHEREAS, the parties wish to amend the Agreement as set forth herein. NOW, THEREFORE, it is stipulated and agreed as follows: I. RECITALS The Bus Shelter Agreement and Addendum shall remain in full force and effect except as may be modified herein. • II. SHELTER ILLUMINATION All bus shelters shall be illuminated from approximatley sunset to sunrise. All illumination shall be controlled by a photo electric cell. III. SHELTER INSTALLATION The parties agree that Company shall have no obligation to install shelters where electric power is not available. After installation, Company shall not be deemed in breach in the event of any interruption of electric power through causes not in control of Company. IV. CCUSNSATION Paragraph IX of the Addendum shall be modified to read that commencing October 1, 1990, Tamarac shall be entitled to receive the sum of Twenty -Five and no/100 ($25.00) Dollars per month per shelter for all shelters upon which advertising is sold under contract and placed thereon. This obligation shall not be contingent upon Company's collection of rentals for said advertising. The Tamarac compensation fi -3 shall terminate upon termination of the advertising con shall re -commence upon the execution of any subsequent con placement of advertising on the shelter by Company. Publi advertising placed at no charge and any Company advertis not be the subject of compensation. IN WITNESS WHEREOF, the parties hereto have set their hands the day and year first above written.
