Reso. # 4881 REVISED 12/23/87 CITY OF TAMARAC, FLORIDA RESOLUTION NO. R-87-�ZQ V A RESOLUTION ISSUING DEVELOPMENT ORDER NO. 224 FOR WOODMONT GARDENS PROJECT; APPROVING A FINAL SITE PLAN PURSUANT TO THE PROVISIONS OF SECTIONS 7-2 THROUGH 7-11 OF THE TAMARAC CITY CODE; PROVIDING FOR PHASED DEVELOPMENT OF THE WOODMONT GARDENS PROJECT; PROVIDING FOR CONDITIONS ON SAID PHASED DEVELOPMENT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instruction of the City Council of Tamarac, Florida, a public meeting has been advertised in accordance with applicable state law; and WHEREAS, the City Council has examined and reviewed the attached application for development order, staff and Planning Commission recommendations, and the attached Development Review Status Sheet dated December 15, 1987; and WHEREAS, the City Council has reviewed the development order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the application is in compliance with all elements of the Compre- hensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application; and WHEREAS, the City of Tamarac wishes to approve a development plan for a 300 bed Adult Congregate Living Facility; and WHEREAS, the developer has requested City Council approval to master plan the development into two phases; and WHEREAS, the City staff has reviewed the request and recommends that if the development is master planned that the fees for C.I.A.C. charges be $222,570.00 for the first phase consisting of no more than 180 beds; and WHEREAS, the City staff has recognized that the 2nd phase of this development may be delayed and that C.I.A.C. fees may increase, and that the fees as they increase will be =-a Temp. Reso. #4881 1 charged to this development when this project is submitted to 2 the Staff for the final Second Phase consisting of no more 3 than 120 beds; and 4 WHEREAS, City staff recognizes that the Broward County 5 Ordinance No. 85-92 has been complied with and the Plat is 6 restricted to 300 beds for Adult Congregate Living Facility 7 use only and that the future development of Phase 2 must 8 permit the continuation of the master plan site configuration 9 as shown on Exhibit "A"; and 10 WHEREAS, any deviations to the site plan (shown on 11 Exhibit "A") may conflict with the number of Broward County 12 approved Adult Congregate Living Facility units; and 13 WHEREAS, staff recommends approval of the Master site 14 plan for both Phase 1 and 2; and 15 WHEREAS, City staff has no objections to approving Phase 16 1 site plan as submitted with C.I.A.C. fees paid prior to 17 18 City Council consideration, 19 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 20 CITY OF TAMARAC, FLORIDA: 21 22 SECTION 1 . That the Woodmont Gardens site plan is 23 hereby approved as a master plan for an Adult Congregate 24 Living Facility use subject to the restrictions, setbacks, 25 traffic circulation, and site configuration as shown on 26 Exhibit 27 SECTION 2 : That the 1st phase of the development will 28 allow for 180 beds as shown on Exhibit "B" with C.I.A.C. fees 29 in accordance with the fee schedule for A.C.L.F. uses. 30 SECTION 3 : Commencement of construction phase 1 shall 31 be no longer than one g year from the date of this approval. 32 If the development does not commence construction within one 33 year, this approval is null and void unless an extension has 34 been granted in accordance with applicable regulations. 35 SECTION 4 : That Phase 2 will consist of no more than 120 beds for A.C.L.F. uses. -2- Temp. Reso. #4881 1 2 3 C! 5 6 7 8 CJ 10 11 12 13 14 0IM 16 17 18 i9 20 21 22 23 24 25 26 27 28 29 0 "31 32 33 34 35 SECTION 5 : That Phase 2 development must be consistent with the overall master plan shown on Exhibit A and all traffic needs fees and C.I.A.C. fees for Phase 2 are to be charged at the going rate for the year that Phase 2 is ready to continue construction. SECTION 6 : That in no event shall Phase 2 be permitted any deviation from the approved master site plan. SECTION 7 : In the event that development of Phase 2 does not occur within 4 years of the date of this Resolution, then the Resolution shall become null and void. SECTION 8 : The development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. Additional con- ditions established in order to issue the development order are set forth as follows: Approval subject to rezoning of lands from B-3 to RM-5 and receipt of confir mation from Broward Planning council that Land Use and compliance with all requirements of County Ordinance 85-92 are met. SECTION 9 : That the following documents are hereby accepted and approved as a part of this development order: A. water and Sewer Developers Agreement B. Blanket Safety Ingress/Egress Easement C. Developers Agreement SECTION 10 : Should any section or provision of this development order be declared by a court of competent juris- diction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. -3- Temp.
