R-87- 2 A RESOLUTION ISSUING WOODMONT TRACT 59 3 REVISED DEVELOPMENT ORDER NO. 168-2 FOR A REVISED SITE PLAN FOR REVISED PARKING 4 AND CHANGE OF UNIT MIX PURSUANT TO PRO- VISIONS OF SECTION 7-2 THRU 7-11 OF THE TAMARAC CODE; AND PROVIDING AN EFFECTIVE DATE. 6 7 8 WHEREAS, pursuant to the instructions of the City 9 Council of Tamarac, Florida, a public meeting has been 10 advertised in accordance with applicable law of the date, 11 time and place of the meeting regarding the review of the 12 application for a revised development order by the applicant 13 for development approval; and 14 WHEREAS, the City Council has examined and investigated 15 the application and staff recommendations and the attached 16 Development Review Status Sheet dated January 29, 1987; and 17 WHEREAS, the City Council reviewed the revised develop- s ment order and accompanying documents at a public meeting; 19 and 20 WHEREAS, the City Council has determined that the 21 application is in compliance with all elements of the Compre- 22 hensive Plan, or will be in compliance prior to the issuance 23 of a Certificate of Occupancy for the development that is the 24 subject of the application. 25 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 26 TAMARAC, FLORIDA: 27 ,SECTION 1: That application for approval of a revised 28 site plan for Woodmont Tract 59 prepared by Keith and 29 Schnars, P.A., revised January 14, 1987, to reflect revised 30 parking and change of unit mix is hereby approved subject to 31 the following conditions: 32 A. Construction is to be in complete compliance with 33 the plans and specifications submitted by the developer to 34 the City of Tamarac as described in Section II of the 35 Development Review Status Sheet and approved engineering 36 drawings. -1- Temp. Commencement of construction shall be no longer than one year from the date of this approval. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The revised development order is assignable, but an assignment does not discharge and assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the revised development order are set forth as follows: IV on/E SECTIO 2: That the following documents are hereby accepted and approved as a part of this development order: NONE SECTION T3: Should any section or provision of this revised development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void.
