A RESOLUTION ISSUING BONAIRE AT WOODMONT
4 TRACTS 74 AND 75 REVISED DEVELOPMENT RE-
VISED DEVELOPMENT ORDER NO 21-18 FOR SITE
PLAN #7 PURSUANT TO PROVISIONS OF SECTION
7-2 THRU 7-11 OF THE TAMARAC CODE; AND
PROVIDING AN EFFECTIVE DATE.

WHEREAS, pursuant to the instructions of the City
9
Council of Tamaraq, Florida, a public meeting has been adver-
10
ti:sed in accordance with applicable law of the date, time and

place of the meeting regarding the review of the application
12
for a revised development order by the applicant for
13
development approval; and
14
WHEREAS, the City Council has examined and investigated
15
the application, staff and Planning Commission recommenda-
lb
tions and the attached Development Review Status Sheet dated
17
January 30, 1987; and

WHEREAS, the City Council reviewed the revised develop-
19
ment order and accompanying documents at a public meeting;
20
and
21
WHEREAS, the City Council has determined that the
22
application is in compliance with all elements of the Compre-
23
hensive Plan, or will be in compliance prior to the issuance
24
of a Certificate of Occupancy for the development that is the
25
subject of the application.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
27
TAMARAC, FLORIDA:

$ESQU'ION 1: That the development described on the
29
attached development review status sheet dated January 30,
30
1987, is granted a revised development order to proceed
31
subject to the following conditions:

A. Construction is to be in complete compliance with
33
the plans and specifications submitted by the developer to
34 the City of Tamarac as described in Section II of the De-
35

velopment Review Status Sheet and approved engineering
drawings.
B. Commencement of construction shall be no longer than
1
one year from the date of this approval. If the development
2
does not commence construction within one year, this approval
3
is null and void unless an extension has been granted in
4
accordance with applicable regulations.

C. The revised development order is assignable, but an
6
assignment does not discharge any assignee from strict
7
compliance with the order unless the City Council consents to

modify any of the original requirements.

D. Additional conditions established in order to issue
10
the revised development order are set forth as follows-:

,SEC,T ON 2: That the following documents are hereby
14
accepted and approved as a part of this development order:

�A. Water and Sewer Developer's Agreement.
16
B. Public Safety Ingress/Engress Easement.
17
C. Hold Harmless Agreement.

D. Irrevocable option.

SECTION 3: Should any section or provision of this
20
revised development order be declared by a court of competent
21
jurisdiction to be invalid, the City Council shall determine
22
if the other portions of the order remain valid or whether
23
the approval shall be null and void.

25
become effective immediately upon its passage.
