RESOLUTION NO. R-87-.55
A RESOLUTION AWARDING A BID FOR THE
CONSTRUCTION OF THE TAMARAC MUNICIPAL
COMPLEX/CITY HALL, BID #86--39; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council authorized the Administration
to go to bid at its meeting on December 10, 1986; and
WHEREAS, the bids were advertised in the Fort
Lauderdale/Sun Sentinel News, a newspaper of general cir-
culation on January 7, 1987 and January 13, 1987; and
WHEREAS, James A. Cummings, Inc., is the lowest fully
responsive and responsible bidder.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
BSTIQN 1: That the bid of James A. Cummings, Inc., in
the amount of $4,268,450.00, which amount is comprised of the
Base Bid and Alternates No. 1, 21 3, 4, 5 and 6, is HEREBY
APPROVED.
ION 2: That the appropriate City Officials are
hereby authorized to execute any and all contract documents
necessary in connection with this bid award.
SECTIQN 3: This Resolution shall become effective
immediately upon adoption.

Gentlemen:
The Bidder, in compliance with your invitation to bid for the
construction of the following project:

Having examined the plans and specifications with related documents,
the existing building and the site of the proposed work, and being
familiar with all of the conditions surrounding the proposed
construction of the project including the availability of materials
and labor, hereby proposes to furnish all labor, materials, and
supplies, to construct the project in accordance with the Contract
Documents; within the time set forth therein, and at the prices
stated below. These prices are to cover all expenses incurred in
performing the work required under the Contract Documents, dated
December 9, 1986.
Bidder hereby agrees to commence work under this Contract upon
receipt of "Notice to Proceed" and shall fully complete the project
by Four Hundred Five (405) Days as stipulated in the Contract
Documents.

All Bidders submitting a Base Bid shall also submit Alternative
Bids. The Owner reserves the right to accept any of the Alternate
Bids and add them to the Base Bid or accept Base Bid as submitted in
the selection of the low responsible bidder.
The Bidder understands that the Owner reserves the night to reject
any or all Bids and to waive any informalities in the Bidding.
The Bidder agrees that this bid shall be valid and may not be
withdrawn for a period of forty-five (45) calendar days after the
scheduled closing time for receiving bids.
Upon receipt of written notice of the acceptance of this bid, the
Bidder will execute the formal contract and deliver a Surety Bond or
Bonds as required by the Contract Documents.
The bid security attached in the sum of Five Percent of the
Bid Amount Dollars ($ 5% )
is to become the property of the Owner in the event the contract and
bond are not executed within the time set forth, as liquidated
damages for the delay and additional expense to the Owner caused
thereby.

hereinafter called "Owner", in the sum of five (5%) of the

faithful performance and the other to guarantee payment for labor and
material, then this obligation shall be null and void, otherwise it
shall remain in full force and effect. In the event suit is brought
upon this bond by said Owner and judgment is recovered, said Surety

reasonable attorney's fee to be fixed by the court.
