CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-87-�
A RESOLUTION GRANTING A TEMPORARY EXCEPTION
PERMIT TO LARRY E. SMITH, EUCALYPTUS REALTY
TRUST, IN LIEU OF SATISFACTION OF THE PLATTING
PREREQUISITE AS PROVIDED IN CHAPTER 20 OF THE
TAMARAC CODE OF ORDINANCES, FOR THE 4100 WEST
COMMERCIAL BOULEVARD BUILDING ; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Larry E. Smith, Eucalyptus Realty Trust has
applied for a temporary exception permit in lieu of satisfy-
ing certain platting requirements of Chapter 20 of the
Tamarac Code of Ordinances; and
WHEREAS, the property is described as the East 50 feet
of Parcel C, of THE MAINLANDS OF TAMARAC LAKES, together with
a portion f Lot 9, of FORT LAUDERDALE TRUCK FARMS SUB-
DIVISION of Section 13, Township 49 South, Range 41 East; and
WHEREAS, the property involved is owned by Larry E.
Smith, Eucalyptus Realty Trust; and
WHEREAS, the Broward County Land Use Plan, Chapter 4,
Section 5.02, would not require platting for issuance of
permits for construction of alternations or additions which
are smaller than the original structure.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
TAMARAC, FLORIDA that:
,SECTION.,.„1: That the following findings of fact are
made pursuant to Section 20-4 of the Tamarac Code of Ordi-
nances regarding the development of the property involved.
A. An undue hardship would be imposed if all the
standards set for in Chapter 20 were complied with and such
compliance would thus be unreasonable.
B. The granting of this exception would not set a
precedent in any way for other and unlike conditions.
C. Such permit for exception would not be detrimental
to the interests of the community as set forth in Chapter 20.
D. The property is adequately served with water and
sewer facilities and no further construction is contemplated.

E. No additional road right-of-way dedications are
required.

F. No additional easements, including water, sewer and
storm drainage, are required.
G. No dedication of recreational land is required under
Chapter 20.
SECTION 2: That a temporary exception permit is hereby
granted to Larry E. Smith, Eucalyptus Realty Trust, in lieu
of satisfaction of the platting requirements of Chapter 20 of
the Tamarac Code of Ordinances for the above described
property.
SECTION _3: That the following conditions are hereby
placed on this permit:

immediately upon adoption.
