R-87- iv 7 A RESOLUTION APPROVING AMENDMENTS TO THE TAMARAC LAND USE ELEMENT FLEXIBILITY ZONE SIXTY (60) PROVIDING FOR USE OF SMALL SCALE DEVELOPMENT IN ACCORDANCE WITH STATE STATUTE 163.3187; AUTHORIZING SUBMISSION TO THE BROWARD COUNTY PLANNING COUNCIL FOR RECERTIFICATION THEREOF; CASTRO CONVERTIBLES,INC. PETITION 1,10. 5-LUA-87; AND PROVIDING AN EFFEC- TIVE DATE. WHEREAS, the City has adopted a Land Use Plan Element which has been certified by the Broward County Planning Council; and WHEREAS, the purpose of this amendment is to change from Community Facility Land Use to Commercial Land Use Category and complies with the category as outlined for Small Scale Development; and WHEREAS, applicant has submitted an application to amend Flexibility Zone #60 and has studied the area to provide for the City's future needs to create Commercial Land Use designation, within Flexibility #60; and WHEREAS, the City of Tamarac is not required to comply with the requirements for Plan Amendments if the local government sudstantially complies, with the provisions of State Statute 163.3184; and WHEREAS, the City of Tamarac has legally advertised in a newspaper of general circulation within local government jurisdiction; and WHEREAS, the City of Tamarac has submitted to the State of Florida for review and determination by the State Land Planning Agency; and WHEREAS, the City has studied this area in such a way as to preserve the internal consistency of the Land Use Plan pursuant to State Statute 163.3172; and WHEREAS, the City of Tamarac has transmitted to the State Planning Agency a current copy of its comprehensive plan and amendments to its comprehensive plan so as to continually update plans on file with the State Planning Agency. WHEREAS, the City has held public hearings to amend the Land Use Plan Element at which parties in interest and all other citizens so desiring had an opportunity to be and were heard. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the amendments to the Land Use Plan Element of the Comprehensive Plan for the City of Tamarac, attached hereto and made a part hereof as Exhibit "A", are hereby approved with the changes included by the City Council during the public hearing. Florida re; Land Use Amendment - southeast corner of University Drive and N.W. 76th Street On behalf of our client, Castro Convertibles, Inc. we have applied for a land use amendment from a "Community Facilities" designation to that of a "Commercial" one. The need for this amendment is to accommodate the use of the property as a furniture retail facility. The property's current use is that of a Church (All Saints Lutheran Church) and the proposed use is that of a furniture retail store (Castro Convertibles). This amendment application is based on the following reasons. - The Church's membership has grown to the level that the existing facility can no longer support their spatial needs. - After studying the situation and evaluating their needs (existing and anticipated) the Church has concluded that both the facility and the parcel cannot accommodate their requirements. The present facility cannot be expanded in a cost-efficient wanner that will meet the spatial demands of the Church. This knowledge coupled with the fact that the parcel of land contains only two acres (gross) did not support a decision to expand at the current • location. - Increased traffic demands and congestion on University Drive have had an adverse impact on the passive setting that is very desireable to a place of worship and the services offered. - It is our opinion that the recent development of Commercial uses nearby as well as the overall increase in Commercial intensive activities along the entire University Drive corridor has redirected this land's "highest and best use" to be more closely associated with that of "Commercial" rather than a "Community Facilities". It is for these reasons that the Church concluded that it is in both the City's and their best interests to seek another site and sell their current facility for commercial purposes. Non-residential uses such as commercial and community facilities are treated the same as in other study areas. The City Land Use Plan Map, in conjunction with the permitted uses within each of the land use categories, determines the amount and location of these uses. Statistical City Summary The following is a statistical summary of the Tamarac Future Land Use Plan. Table 2 summarized the land uses on the Land Use Plan Map by the acreage of each land use category, for each study area and for the City as a whole. Table 3 lists the number of dwelling units permitted in each study area and the City as a whole, on the City Land Use Plan Map, and the County Land Use Plan, and lists the number of reserve units in each study area and the City as a whole. Table 3 also indicates the overall gross density represented on the City Land Use Map in each study area.
