R-87- / l 3 A RESOLUTION ISSUING DEVELOPMENT ORDER NO. 217 4 FOR A FINAL SITE PLAN FOR CASTRO CONVERTIBLES PURSUANT TO PROVISIONS OF SECTION 7-2 THRU 7-11 OF THE TAMARAC CODE; AND PROVIDING AN 7 EFFECTIVE DATE WHEREAS, pursuant to the instructions of the City 7 Council of Tamarac, Florida, a public meeting has been 8 advertised in accordance with applicable law of the,date, 9 time and place of the meeting regarding the review of the 10 application for a development order by the applicant for 31 development approval; and 32 WHEREAS, the City Council has examined and investigated 13 the application, staff and Planning Commission recommend- 14 ations and the attached Development Review Status Sheet dated 15 March 13, 1987; and 16 WHEREAS, the City Council reviewed the development order 17 and accompanying documents at a public meeting; and Ia WHEREAS, the City Council has determined that the application is in compliance with all elements of the Com- 20 prehensive Plan, or will be in compliance prior to the 21 issuance of a Certificate of Occupancy for the development 22 that is the subject of the application. 23 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 24 -TAMARAC, FLORIDA: 25 SECTION 1: That the development described on the 26 attached- development review status sheet dated March 13, 27 1987, is granted a development order to proceed subject to 28 the following conditions: 29 A. Construction is to be in complete compliance with f3p the plans and specifications submitted by the developer to 1 the City of Tamarac as described in Section II of the De- 32 velopment Review Status Sheet and approved engineering 33 drawings. 34 35 36 1 Temp. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The development order is assignable, but an assign- ment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the development order are set forth as follows: The height of the wall on the east lot line be reduced to 3 feet in height 25 feet from the NW 76 Street property line. EECCTTIO_N_2: That the following documents are hereby accepted and approved as part of this development order: A. Development Review Agreement. B. Public Safety Ingress/Egress easement. C. Water Retention Agreement. SE!QTIQN3: Should any section or provision of this development order be declared by.a court of competent juris- diction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the -approval shall be null and void.
