CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-87- 93
A RESOLUTION PROVIDING FOR AN AMENDMENT TO
THE DECLARATION OF RESTRICTIONS FOR TAMARAC
POINT ELIMINATING THE PROVISION FOR ADULTS
ONLY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS; the City of Tamarac has studied the need
to have a development within the City of Tamarac which
allows for children; and
WHEREAS, the Developer of Tamarac Point has
indicated to the City that he wishes to amend the
Declaration of Restrictions to include a provision to
allow children to occupy the premises; and
WHEREAS, the City of Tamarac has made an effort to
work with -the developer and has studied the need and
the services available.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the amendment to the Declaration
of Restrictions for Tamarac Point, attachedhereto and
made a part hereof as Exhibit "A".
SECTION 2: This Resolution shall become effective
immediately upon its passage.

AMENDMENT TO
DECLARATION OF RESTRICTIONS
KNOW ALL MEN BY THESE PRESENTS that the undersigned, CITY OF TAMARAC, a
101unicipal corporation organized and existing under the laws of the State of
Florida ("CITY"), and TAMARAC POINTE, LTD., LIMITED PARTNERSHIP, an Ohio
limited partnership ("TAMARAC POINTE"), being the titleholder of record of the
following described property located in Broward County, Florida, to wit:
Parcel "A" of "The Mainlands of Tamarac Lakes, Unit
Fifteen", according to the plat thereof recorded at
Plat Book 71, Page 3 of the Public Records of Broward
County, Florida, also known as TAMARAC POINTE
CONDOMINIUM, according to the Declaration thereof
recorded in Official Record Book 13763, Pages 289-385,
of the Public Records of Broward County, Florida,
hereby voluntarily amend the Declaration of Restrictions dated May 16, 1984,
and recorded August 12, 19859 in Official Record Book 12741, Page 556, under
Clerk's File No. 85-267226 of the Public Records of Broward County, Florida,
as follows:
I. The restriction contained in Paragraph 1 of the subject Declaration
�f Restrictions recorded in Official Record Book 12741, Page 556 of the Public
ecords of Broward County, Florida, is hereby deleted, in its entirety, and
the same shall be deemed null and void and of no further force and effect.
2. In recognition of the fact that the restriction contained in
Paragraph I of the aforedescribed Declaration of Restrictions is the only
restriction contained therein, said Declaration of Restrictions is hereby
deemed soot and of no further force and effect, and this Amendment of
Declaration of Restrictions is made in contemplation of Paragraph 2 of the
aforestated Declaration of Restrictions which, in pertinent part, required
that any amendment or removal of such Declaration could only be achieved by
the City of Tamarac, Florida, by a written document of equal formality and
dignity and with the approval of the undersigned or successors in title or
assigns after holding the requisite advertised public hearing and adoption of
an appropriate resolution.
