R-87- / 7 A RESOLUTION APPROVING AND AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE AN AMENDMENT TO AN AGREEMENT BETWEEN THE CITY OF TAMARAC AND REACTOR CONTROLS, INC., PERTAINING TO PROJECT #86-5 (201 PUMP STATION); AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the City Council of the City of Tamarac hereby approves an Amendment Number One between the City of Tamarac and Reactor Controls, Inc., pertaining to Project #86-5 (201 Pump Station), attached hereto and made a part hereof as Exhibit "A"• SECTION 2: That the appropriate City Officials are hereby authorized to execute said Amendment. SECTION 3: This Resolution shall become effective immediately upon adoption. PASSED, ADOPTED AND APPROVED this day of o 1987. ATTEST: CAROL E. (PROJECT 1 RUMP STATIQN) This Amendment entered into on the �_ day of , 1987, is made by and between the City of Tamarac, a municipal corporation, hereinafter "CITY" and Reactor Controls, Inc., hereinafter "Contractor". W I T N E S S E T H: WHEREAS, CITY and CONTRACTOR entered into an agreement for the 201 Pump Station Project with CONTRACTOR; and WHEREAS, CITY has pledged to be connected to the County system by November, 1987; and WHEREAS, CITY'S consulting Engineers and the Utilities/Engineering Department has recommended a "Bonus Schedule" for early completion by CONTRACTOR to provide an incentive to complete the project ahead of schedule and to save additional cost; and WHEREAS, the proposed "Bonus Schedule" will not exceed $15,000.00. NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties agree as follows. SECTIQ�i____I: That ARTICLE TWO of said Contract is hereby amended by adding the following paragraph: "If CONTRACTOR substantially completes the project prior to the 350 day deadline (September 29, 1987) CONTRACTOR shall receive a bonus of $500.00 per day. However, it is expressly understood between the parties that this bonus shall not exceed $15,000.00 (30 days). Substan- tial completion, as used in this paragraph, shall mean that the 201 Pump Station is on-line and pumping all sewage delivered to the pump station to the Broward County Regional Waste- water Treatment Plant. The pumps, motors, drives and all necessary equipment or systems shall be fully tested by the Contractor and accepted by the Owner and capable of pumping 24 hours per day continuously. It is the intent of this contract that the Tamarac Wastewater Treatment Plant will no longer be required upon substantial completion. -1- So < Should the R.C.I. formally request any contract time extension(s) which are ultimately approved and accepted by City Council, all such time extensions will be automatically deducted from this 30-day bonus provision regardless of reason. Final acceptance of the completed project shall be pursuant to contract requirements and final completion by CONTRACTOR." ZECTIQNThis Amendment shall not in any form or manner affect any of the existing provisions of the Contract and shall not relieve CONTRACTOR of any existing requirements or conditions delineated in the Contract.
