R-86-,2,7_ A RESOLUTION APPROVING AND ACCEPTING A DEC- LARATION OF RESTRICTIONS FOR CROSS -PARKING, COMMON INGRESS AND EGRESS AND COMMON SANI- TARY DUMPSTER USE OFFERED BY PROGRAM UNDER- WRITERS INC., FOR PROGRAM UNDERWRITERS OFFICE BUILDING NO. 2; AND PROVIDING AN EFFECTIVE -DATE, BE -IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the Declaration of Restrictions for cross - parking, common ingress and egress and common sanitary dumpster use offered by Program Underwriters Inc., for Program Under- writers Office Building No. 2 project, is HEREBY APPROVED and accepted, a copy of said declaration being attached hereto as Exhibit "1". E TI 2: The City Clerk is hereby authorized and directed to record said utility easement in the public records of Broward County, Florida. ATTEST: CITY/CLERK if I HEREBY CERTIFY that I have approved the foi and correct- ness of this R 7 OLUTION. r RECORD OF COUNCIL VOTE MAYOR: KRAVITZ DIST 4: C/M VEIN DIST 3: C/M GOTTESMAN DIST 2: C/M MUNITZ DIST 1: WRI IUIA5" ARO 6241 0 !J C'0' DECLARATION OF RESTRICTIONS FOR CROSS --PARKING COMMON INGRESS AND EGRESS AND COMMON SANITARY DUMPSTER USE KNOW ALL MEN BY THESE PRESENTS that the undersigned, PROGRAM UNDERWRITERS, INC., a Florida corporation, being the titleholder of record of the following described property located in the City of Tamarac, Broward County, Florida, to wit: Lots 8, 9 and 10, Block 11 of the plat of Lyons Commercial Subdivision No. 3 according to the Plat thereof recorded at Plat Book 76, Page 31 of the Public Records of Broward County, Florida, as depicted upon Exhibit A, attached hereto and made a part hereof (Property), does hereby voluntarily make the following Declaration of Restrictions covering the Property, specifying that this Declaration of Restrictions shall constitute as a covenant running with the land and that this dedication shall be binding upon the undersigned and upon all persons deriving or taking title through the undersigned. These restrictions, during their lifetime, shall be for the benefit of the CITY OF TAMARAC, Florida, and shall be enforceable by said City. 1. The Property shall be subject to the following restrictions: (a) The parking area(s) and parking amenities existing on a portion or any part of the Property, from time to time, shall be subject to the use and enjoyment of all of the occupants, licensees, invitees and other users of the Property, such that the parking facilities on any one of the lots comprising the Property shall be for the benefit of the remaining lots comprising the Property; (b) The points of ingress and egress which shall provide access to any portion of the Property shall be subject to the use and enjoyment of all of the occupants, licensees, invitees or other users of the Property; (c) The sanitary dumpster facilities which shall be provided on or to any portion of the Property shall be subject to the use of all occupants, licensees, invitees and other users of the Property. 2. These covenants are to run with the Property and shall be binding upon all parties and persons deriving or taking title through the undersigned for a period of ninety-nine (99) years from the date these covenants are recorded in the Public Records of Broward County, Florida. This Declaration of Restrictions may be amended or removed only by the City of Tamarac, Florida, by a written document of equal formality and dignity and with the approval of the undersigned or its successors in title or assigns after holding the requisite advertised public hearing and adoption of an appropriate resolution. Any amendment to this Declaration of Restrictions or termination thereof shall be recorded in the Public Records of Broward County, Florida. Nothing herein shall prevent the declarant or its successors in title or JCB/b 00041. an tI IN ■ 1 assigns from applying to the City of Tamarac, Florida, for a modification of this Declaration of Restrictions or termination hereof. 3. Invalidation of any one portion of this Declaration of Restrictions or any portions of this document by judgment or court order in no wise shall affect any other provisions which shall remain in full force and effect. 4. This Declaration of Restrictions is executed for the purpose of protecting the health, safety and welfare of the occupants, licensees and Invitees of the above described lands.
