RESOLUTION NO. R--86- /Ok
A RESOLUTION APPROVING AND ACCEPTING A PUBLIC
SAFETY INGRESS/EGRESS EASEMENT OFFERED BY
CALIFORNIA FEDERAL SAVINGS AND LOAN ASSOCIA-
TION FOR PUBLIC ACCESS OVER COMMON FACILITIES
AND PROVIDING AN EFFECTIVE DATE,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 11 That the Public Safety Ingress/Egress
easementi offered by California Federal Savings and Loan
Association for Public access over common facilities project is
HEREBY APPROVED and accepted, a copy of said easement being
attached hereto as Exhibit "1".
SECTION 2: The City Clerk is hereby authorized and
directed to record said utility easement in the public records
of Broward County, Florida.
SECTION 3: This Resolution shall be become effective
upon adoption.

ASSIGNMENT OF PUBLIC SAFETY
INGRESS/EGRESS EASEMENT
Assignment made this /V day of z�,�,,z 5 1986 by CALIFORNIA
FEDERAL SAVINGS AND LOAN ASSOCIATION,'a United States corporation ("Cal Fed") to
CITY OF TAMARAC, a municipal corporation ("City").
WHEREAS, Lakes of Carriage Hills, Inc., C.F. Holdings, Inc. and Cal Fed entered into that
certain Construction, Operation and Reciprocal Easement Agreement (the "Easement Agreement")
dated July 3, 1985 and recorded in Official Records Book 12971, Page 276 of the Public Records of
Broward County, Florida; and
WHEREAS, the Easement Agreement grants to Cal Fed a non-exclusive easement for the
use of portions of that certain real property more particularly described in Exhibits "A-l" and "A-
2"; and
WHEREAS, Cal Fed desires to assign certain ingress and egress easement rights under the
Easement Agreement to the City as hereinafter set forth.
NOW THEREFORE, in consideration of the sum of One Dollar ($1.00) paid to Cal Fed, the
receipt and adequacy of which is hereby acknowledged, and for other good and valuable
considerations, Cal Fed does hereby assign to City a non-exclusive ingress and egress easement
under the Easement Agreement for the purpose of permitting public ingress and egress over the
sidewalks, service lanes, parking aisles, driveways, streets, parking areas, and other Common
Facilities (as that term is defined in the Easement Agreement) to provide municipal services such as
utility maintenance or construction, fire protection and emergency and other public safety services.
Cal Fed does not by the execution of this Assignment release any of its rights under the Easement
Agreement, it being the intent of the City and Cal Fed that the easement granted City is non-
exclusive and shall be used in common with the Tights of Cal Fed and all other parties under the
Easement Agreement.
IN WITNESS WHEREOF, the parties have executed this Assignment of Public Safety
Ingress/Egress Easement the date and year first above written.
