R-86-Z&Q 2 A RESOLUTION ISSUING REVISED DEVELOPMENT 3 ORDER NO. 042-4 FOR A REVISED SITE PLAN FOR WOODMONT TRACT 48; AND PROVIDING AN EFFEC- 4 TIVE DATA S WHEREAS, pursuant to the instructions of the City Council of 6 Tamarac, Florida, a public meeting has been advertised in accord- 7 ance with applicable law of the date, time and place of the meet- ing regarding the review of the application for a revised develop- 9 ment order by the applicant for development approval; and 10 WHEREAS, the City Council has examined and investigated the 11 application and staff recommendations; and the attached Develop- 12 ment Review Status Sheet dated 4/2/86; and 13 WHEREAS, the City Council reviewed the revised development 14 order and accompanying documents at a public meeting; and IS WHEREAS, the City Council has determined that the applica- 16 tion is in compliance with all elements of the Comprehensive Plan, 17 or will be in compliance prior to the issuance of a Certificate of 18 Occupancy for the development that is the subject of the applica- 19 tion. 20 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 21 TAMARAC, FLORIDA: 22 ,SECTION 1: That the application for approval of a revised 23 site plan for Woodmont Tract 48, prepared by Keith and Schnars, 24 P.A., revised March 25, 1986, to reflect revisions to walkway to 25 sales center, addition of a fence, removal of 19 space parking lot 26 and temporary paving for grassed parking spaces, is approved sub-- 27 ject to the following conditions: 28 A. Construction is to be in complete compliance with the 29 plans and specifications submitted by the developer to the City of 30 Tamarac as described in Section II of the Development Review 31 Status Sheet and approved engineering drawings. 32 B. Commencement of construction shall be no longer than one 33 Year from the date of this approval. The revised development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the revised development order are set forth as follows: SECTION 2: Should any section or provision of this revised development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void.
