A RESOLUTION OF THE CITY OF TAMARAC, FLORIDA
APPOINTING JOHN P. KELLY AS CITY MANAGER
PROVIDING FOR A STARTING DATE OF EMPLOY-
MENT; PROVIDING FOR A STARTING SALARY
WITH A GUARANTEED INCREASE IN SALARY OF
$5,000 UPON COMPLETION OF A SUCCESSFUL
SIX (6) MONTH PROBATIONARY PERIOD; PRO-
VIDING FOR A SIX (6) MONTH PROBATIONARY
PERIOD FOR EMPLOYMENT; PROVIDING FOR
BENEFITS AND A CAR ALLOWANCE; PROVIDING
FOR SEVERANCE PAY UPON TERMINATION BY
THE COUNCIL SHOULD SUCH TERMINATION
OCCUR AFTER A SUCCESSFUL PROBATIONARY
PERIOD; PROVIDING THAT KELLY IS AN
AT WILL EMPLOYEE; PROVIDING FOR WRIT-
TEN NOTICE TO CITY SHOULD KELLY DESIRE
TO TERMINATE HIS EMPLOYMENT; PROVIDING
THAT KELLY SHALL ATTEND SEVERAL CONFER-
ENCES AT CITY EXPENSE ; AND PROVIDING
FOR AN EFFECTIVE DATE. _
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA THAT:
SECTION 1: JOHN P. KELLY shall be appointed to serve as
City Manager of the City of Tamarac subject to the
following conditions, which KELLY has agreed to by signature
to a letter of May 21,..1986, a copy of which is attached as
Exhibit "A", and incorporated by reference herein:
1. KELLY will begin to serve as City Manager on July
1, 1986.
2. That as of July 1, 1986, KELLY will receive a
salary of $45,000 per year payable in 26 equal
installments at such pay periods as all other City
Employees are paid.
3. For six (6) months following the first day of
KELLY'S employment, he shall be subject to
probation. Should Council make a determination
to terminate KELLY within said probationary period
or immediately upon the conclusion of said
probationary period, then KELLY shall not be
entitled to severance pay.

4. Upon a successful completion of that six (6) month
probationary period described in paragraph 3,
KELLY shall be automatically entitled to a $5,000
increase in annual salary. As of October 1, 1986,
should KELLY still be employed by the City, he
shall also become eligible for inclusion within the
Executive Managerial benefit plan, the provisions
of which are set forth in Resolution R-86-111, a
copy of which is attached hereto as Exhibit "B" and
incorporated by reference herein.
5. After three (3) months from the period upon which
KELLY begins employment with the City, both he and
his family shall be entitled to participate in
either City hospitalization plan offered to City
employees.
6. Should KELLY continue to be employed by the City on
October 1, 1986, Council will allocate to him a car
allowance in the amount of $300.00 per month.
7. Should/ KELLY be terminated, after a successful
completion of that probationary period described
in paragraph 3 of this Resolution, then he will be
given three (3) months severance pay.
8. In no case, following, prior to, or upon the
conclusion of, that probationary period described
in paragraph 3 of this Resolution shall KELLY be
considered to have a property right in his office.
KELLY is an "at will" employee of the City and may
be terminated without cause at any time by the
Council.

9. Should BELLY desire to terminate this. -agreement at
any time then it will be necessary for him to
provide the City with thirty (30) days prior
written notice.
10. BELLY is authorized, at City expense, to attend the
Florida Industrial Workshop occurring in
Tallahassee, Florida, on July 14-16th, 1986 at a
cost of $494.00. Further, Kelly is authorized, at
City expense, to attend an Industrial Development
Course occurring in Norman, Oklahoma the week of
August 11-15th, 1986 at a cost of $1,068.19. The
Norman, Oklahoma course is the first of three
annual sessions and the City agrees to permit
Kelly's attendance at the next two sessions, at the
City's expense, if KELLY is an employee of the City
at those times in which said courses are held.
SECTION 2: This Resolution shall become effective
immediately upon passage.

Dear John:
We discussed at our meeting the other day, the terms of employment,
and I want to submit them to you in writing, so there is no mis-
understanding as to your salary and benefit package, before you
accept the position as City Manager.
1. Starting salary $45,000 per year, and your starting date will
be Tuesday, July 1st, 1986.
2. six (6) months probationary period.
3. After six (6) months probationary period, $5,000 increment,
making your gross salary $50,000.
4. On October 1st, 1986 you become eligible for the Executive/
Managerial Benefit Plan, Resolution R-86-111 (enclosed).
5. Ninety (90) days after your starting date, you and your family
would be eligible for a choice of one of our hospitalization
plans.
6. On October lst, 1986 you will receive a month car allowance of
$300.
7. If you are terminated by the Council, after the probationary
period, you will be given three (3) months severance pay.
8. On July 14 through 16, 1986, to attend a Florida Industrial
Workshop in Tallahassee, Florida; cost to the City -- $494.
9. On August 11 through 15, 1986, to attend an Industrial Develop-
ment course in Norman, Oklahoma, at a cost of $1,068.19. This
would be the first year of a three (3) year course, one week
each year.
