R-86-a!�22 3 4 A RESOLUTION ISSUING A DEVELOPMENT ORDER FOR THE BEDDING BARN PROJECT; DEVELOPMENT ORDER NO. 198 5 AND PROVIDING AN EFFECTIVE _DATS______________,_._ 0 6 s 7 WHEREAS, pursuant to the instructions of the City Council of 8 the City of Tamarac, Florida, a public meeting has been adver- 9 tised in accordance with applicable law of the date, time and 10 place of the meeting regarding the review of the application for 11 a development order by the applicant for development approval; 12 and 13 WHEREAS, the City Council has examined and investigated the 14 application, staff and Planning Commission recommendation, and 15 the attached Development Review Status Sheet dated 5/23/86; and 16 WHEREAS, the City Council reviewed the development order and 17 accompanying documents at a public meeting; and 16 WHEREAS, the City Council has determined that the applica- G 19 tion is in compliance with all elements of its Comprehensive 20 Plan, or will be in compliance prior to the issuance of a Certif- 21 icate of Occupancy for any unit on the development that is the 22 subject of the application. 23 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 24 TAMARAC, FLORIDA: 25 SECTION I: That the development described on the attached 26 development review status sheet dated 5/23/86 is granted a 27 development order to proceed subject to the following conditions: 28 A. Construction is to be in complete compliance with the 29 plans and specifications submitted by the developer to the City 30 of Tamarac as described in Section II of the Development Review 31 Status Sheet and approved engineering drawings. 32 B. Commencement of construction shall be no longer than one 33 year from the date of this approval. If the development does not 34 commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. -1-- Temp. The development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the orig- inal requirements. D. Additional conditions established in order to issue the development order are set forth as follows: 1) Site Plan Review Committee comments on memorandum dated April 29, 1986. 2) Subject to making outside turning radius forty seven feet. 3) Erecting an "Entrance Only" sign on Commercial Boulevard and erecting an "Exit Only" sign on 57th Street. 4) The trees on Commercial Boulevard be Live Oak and tabe-- buia be interspersed between them. 5) The two trees on either side of the driveway are to be eliminated and in their place bermed flower beds approx- imately eight feet in diameter. 6) If a ground sign is put in, landscaping on either side of the sign will be required. SECTION 2: Should any section or provision of this devel- opment order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other por- tions of.the order remain valid or whether approval shall be null and void. SECTION 3: This development order as conditioned shall become effective immediately upon passage. PASSED, ADOPTED AND APPROVED this 4rday of , 1986.
