Reso. 3920 Rev. 12/16/85 Rev. 01/16/86 Rev. 01/22/86 CITY OF TAMARAC, FLORIDA RESOLUTION NO. R-86-21 A RESOLUTION APPOINTING MR. LARRY PERRETTI AS TAMARAC CITY MANAGER; PROVIDING FOR COMPENSATION; PROVIDING FOR BENEFITS; PRO- VIDING FOR TERMINATION; PROVIDING FOR SEVERA- BILITY; PROVIDING FOR REPEAL OF CONFLICTING RESOLUTIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Larry Perretti had been the Personnel Director of the City and has been serving as the Acting City Manager filling a vacancy in the City Manager position; and WHEREAS, Larry Perretti during his term as an acting City Manager has interacted with the City Council and has effectively managed the City and carried out the policies of the City Council; and WHEREAS, the City Council desires to appoint Larry Perretti as City Manager and establish the terms and con- ditions of that appointment; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That Larry Perretti is hereby appointed for an indefinite term as the Tamarac City Manager to serve at the pleasure of the City Council in accordance with the City personnel manual as it may be amended from time to time as it applies to department heads except as to the following terms and conditions: A. Compensation - Mr. Perretti shall receive a salary of �48,000 annually, payable in installments as the payroll of other City employees is paid. Mr. Perretti shall be on a six months probationary period and after successful completion of probation the City Council shall review the City Manager's compensation. The Council may in its sole discretion increase or decrease said compensation at any time. B. Additional Benefits - Mr. Ferretti shall receive those benefits including sick leave, vacation time, personal time, health insurance and life insurance as set out below: 1. Sick leave accrued at the rate of 1-1/2 days per month, no maximum limit. 2. Group term life insurance policy for $50,000 (premium paid by City). 3. Yearly physical examination of employees by City's doctor at no cost to employee. -1- UU 9 IO 11 12 13 14 15 16 17 1B 31 22 23 24 25 26 27 28 29 30 �1 32. 33 34 4. Vacation benefits shall be as defined in the personnel manual i.e. One (1) day per month first five (5) years of employment. 5. Pension Plan benefits as in effect for City department heads. C. Cancellation -- 1. The appointment of Mr. Perretti as City Manager may be withdrawn by the City Council. Written notice shall be given by the Mayor in advance of effective date. 2. Under such circumstances if no cause is given, Mr. Ferretti shall be demoted to the position of Tamarac Personnel Director, Assistant City Manager, General Services Department Director or any other City position by the City Council without cause. 3. Mr. Perretti, while City Manager, may only be terminated entirely from City employment or demoted below one of the positions listed in the immediately preceding paragraph, for cause. 4. Mr. Perretti shall not be entitled to severance pay for removal from the position of City Manager regardless of the circumstances of removal. Removal of Mr. Perretti from City employment entirely,, following his appointment to City Manager, shall entitle Mr. Perretti only to those severance benefits provided to employees generally by the City's personnel manual. 5. Mr. Perretti shall give the City Council thirty ';U) day written notice of a resignation or forfeit any accrued vacation leave. SECTION 2: Should any section or provision of this ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. ,.E(LT_Q This Resolution shall become effective immediately upon its passage. -2- Hsi PASSED, ADOPTED AND APPROVED this day of- 1986.
