R-86--,Z6 9 2 A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER 3 NO. 152--1 FOR A REVISED SITE PLAN FOR TAMARAC UTILITY WEST WATER TREATMENT ADMINISTRATION 4 BUILDING; AND PROVIDING AN EFFECTIVE DATE. 5 WHEREAS, pursuant to the instructions of the City Council b of Tamarac, Florida, a public meeting has been advertised in 7 accordance with applicable law of the date, time and place of 6 the meeting regarding the review of the application for a 9 revised development order by the applicant for development 10 approval; and 11 WHEREAS, the City Council has examined and investigated 12 the application, and staff recommendations; and the attached 13 Development Review Status Sheet dated 7/16/86; and 14 WHEREAS, the City Council reviewed the revised development 15 order and accompanying documents at a public meeting; and 16 WHEREAS, the City Council has determined that the appli- 17 i cation is in compliance with all elements of the Comprehensive 1B Plan, or will be in compliance prior to the issuance of a Cer- 19 tificate of Occupancy for the development that is the subject of 20 the application. 21 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 22 TAMARAC, FLORIDA: 23 ,SECTION 1: That the application for approval of a revised 24 site plan for Tamarac Utility West Treatment Plant 25 Administration Building, revised July 15, 1986, to reflect 26 an addition to the existing plant control building, is HEREBY 27 APPROVED, subject to the following conditions: 28 A. Construction is to be in complete compliance with the 29 30 plans and specifications submitted by the developer to the City 31 of Tamarac as described in Section II of the Development Review 32 Status Sheet and approved engineering drawings. 33 B. Commencement of construction shall be no longer than 34 one year from the date of this approval. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. -1- Temp. The revised development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original. requirements. D. Additional conditions established in order to issue the revised development order are set forth as follows: /J0i'_)� SECTION 2: Should any section or provision of this revised development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. ,SECTION 3: This revised development order as conditioned shall become effective immediately upon its passage.
