CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-86-2_26'
A RESOLUTION APPROVING AND AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO EXECUTE A HOLD
HARMLESS AGREEMENT WITH THE ITALIAN AMERICAN
CLUB; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the City Council of the City of Tamarac
hereby approves the Hold Harmless Agreement between the City
of Tamarac and the Italian American Club of Tamarac attached
hereto and made a part hereof as Exhibit "A".
SECTION__2: That the appropriate City Officials are
hereby authorized to execute said Agreement.
ECTION This Resolution shall be effective immedi-
ately upon adoption.

This Agreement entered into on theme? day of_,
1906 is made by and between the City of Tamara , a municipal
corporation hereinafter "CITY", and the ITALIAN Ar,1ERICAN CLUB
of Tamarac, hereinafter "CLUB"
W I T N E S S E T h:
WHEREAS, the City Council of the City of Tamarac has
determined that a street festival sponsored by the ITALIAN
AIIER?CAN CLUB of Tamarac which is open to the general public
would be in the public's interest, and
WHEREAS, the City Council is allowing the ITALIAN
AMERICAN CLUB of Tamarac to use a portion of northwest 57th
Street between Northwest 66th Terrace and Northwest 64th
Avenue in the City of Tamarac,
NOW, THEREFORE, in consideration of the sun- of TEN
DOLLARS ($10.00) and other good and valuable consideration
received frog the ITALIAN A14ERICAN CLUB of Tamarac and in
consideration of the mutual covenants contained herein, the
parties agree as follows:
1. The ITALIAN AM�ERICAN CLUB of Tamarac covenants an6
agrees to abide by all requests made by the City Manager of
Tamarac and the Police Chief of Tamarac, or their designees,
in conducting the ITALIAN AMERICAN CLUB Street Festival on
October 16th through 19th, 1956 at the above specified
location.
2. That the CLUE shall hold CITY harmless from any and
all claims, causes of action, damages, costs, expenses an6
attorney fees which the CITY shall suffer by virtue of the
defense of or response to any claim being r�ade against it in
connection «ith the Street Festival conducteCA by the CLUE,,
hereunder or any act or omission of the CLUB, its members,
Is agents, employees, or the general public in connection
therewith.
3. This provision shall survive the termination of
this Agreement and shall pertairi to any occurrence during the
term of this Agreei.ient, even though the claim may be made
after the termination '-iereof.
4. CLUB shall provide to the City risk manager Certi-
ficates of Insurance in such form and amounts as required by
the City risk manager. CLUB shall keep such policies of
insurance in full force and effect during the term of this
Agreement and shall provide to the CITY proof of payment of
required premiums.
5. CLUB shall provide the Risk Manager with the
requisite document evidencing that the signatory for the
ITALIAN AMERICAN CLUB has the authority to enter into this
Agreement.
6. This Agreement shall not be assigned by the CLUB
without first receiving City Council approval.
IN WITNESS WHEREOF, the parties have hereunto set their
hands and seals on the day and year first above written.
