R-86••-o290 A RESOLUTION APPROVING AND ACCEPTING A BILL OF SALE ABSOLUTE FROM THE LANDINGS ON CYPRESS GREENS JOINT VENTURE FOR THE WATER DISTRIBUTION AND SEWAGE COLLECTION SYSTEM IMPROVEMENTS FOR THE LANDINGS ON CYPRESS GREENS (FORMERLY PATIO HOMES AT FAIRMONT); AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA BEC_TI N 1: That the Bill of Sale Absolute offered by The Landings on Cypress Greens Joint Venture for the water distribution and sewage collection system for The Landings on Cypress Greens (formerly Patio Homes at Fairmont) is HEREBY APPROVED. MST. 2: V/M STELZER _ DIST. 3: C/M GOTTESMAN DIST. 4: C/M STEIN._ BILL OF SALE ABSOLUTE (f T Aso. g4-og KNOW ALL MEN BY THESE PRESENTS, That The Landings on Cypress Greens Joint Venture of the City of Plantation, in the County of Broward and State of Florida, Party of the first part, for and in consideration of the sum of Ten and 00/100 ($10.00) Dollars, lawful money of the United States, to be paid by the CITY OF TAMARAC, a municipal corporation of the State of Florida, 5811 Northwest 88th Avenue, Tamarac, Florida, Party of the second part, the receipt of which is hereby acknowledged, has granted, bargained, sold, transferred and delivered and by these presents does grant, bargain, sell, transfer and deliver unto the said Party of the second part, Its successors and assigns, the following goods and chattels: All of the Water Distribution and Sewage Collection System Improvements; together with all appurtenances attached -thereto,-which lie within ^the public Tight -of -way 'or utility easements provided for same in Plat of Patio Homes at Fairmont, Section 1, as recorded in Plat Book 118, Page 29 or within utility easements as indicated on Exhibit A, sheets 1 through 6 of 6 attached. All of the above further described in "As -Built" Plans for Patio Homes at Fairmont, Section 1, prepared by Winningham 6 Fradley, Inc., dated April, 1982 and last revised May 9, 1985, a copy of which is on file with the City of Tamarac. TO HAVE AND TO HOLD the same unto the said party of the second part, its successors and assigns forever. The Party of the first part does covenant to and with the party of the second part, its successors and assigns, that it is the lawful owner of the said goods and chattels; that they are free from all encumbrances other than for existing rights of the public or party of the second part; that it has good right to sell the same aforesaid, and that it will warrant and defend the sale of the said property, goods and chattels hereby made, unto the said party of the second part its successors and assigns against the lawful claims and demands of all persons whomsoever.
