CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-86-�
A RESOLUTION APPROVING AND ACCEPTING A
TAMARAC UTILITIES WEST WATER AND SEWER
UTILITY EASEMENT OFFERED BY C.W.M., INC.
(COLONY WEST COUNTRY CLUB) FOR THE NORTH--
WEST FORCE MAIN PROJECT 84--6; AND PROVIDING
AN EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA
SECTION 1: That the Tamarac Utilities West Water and
Sewer Utility easement offered by C.W.M., Inc. (Colony West
Country Club) for the Northwest Force Main Project 84--6 is
hereby approved and accepted, a copy of said easement being
attached hereto as "Exhibit 1".
SECTION 2: That the appropriate City officials are
hereby authorized to execute said easement on behalf of the
City.
SECTION 3_ That the City Clerk is hereby authorized and
directed to record said easement in the public records of
Broward County, Florida.
SECTION 4: This Resolution shall become effective upon
adoption.
PASSED, ADOPTED AND APPROVED this ��day of 1986.

(Grantor) and the City of Tamarac, a Florida municipal corporation
.--having an address at 5811 Northwest 88th Avenue, Tamarac, Florida,
.3321, (Grantee).
(Whenever used herein, the term "Grantor" and "Grantee" shall include
the respective successors and assigns of the parties hereto, whenever
the context so admits or requires).
WITNESSETH:
WHEREAS, Grantor is the owner of that certain real property
located in Broward County, more particularly described in Exhibit "A"
attached hereto, (hereinafter referred to as "Servient Estate") and
WHEREAS, Grantor desires to grant unto Grantee a non-exclusive
easement to use a portion of the servient estate;
NOW, THEREFORE, in consideration of the sum of TEN DOLLARS
($10.00) and other good and valuable considerations paid by each of the
parties hereto to the other party, receipt of which is hereby acknow-
-edged by both parties, the parties hereto do hereby grant and agree as
follows:
1. Grantor hereby grants and conveys to Grantee, a non-exclusive
temporary construction easement over and upon the servient estate for
the construction of T.U.W. sewer utility.
2. This construction easement will terminate as soon as the
sewer utility is installed. Installation is presently scheduled to
begin in the third or fourth quarter of 1986.
3. Site improvements, including but not limited to landscaping,
will be reconstructed in kind.
4. Construction activities will be limited to area described in
Exhibit "A", but in any event, will not include greens or tees.
.-� 5. All trenches will be backfilled and rough graded the same day
they are excavated. Irrigation facility, if damaged, will be repaired
the same day they are damaged and final grading and spriging will be
completed within two weeks of the completion of the force main between
Pine Island Road and Nab Hill Road, with the intent to minimize inter -
Terence to the golfers and golf course maintenance.

6. Grantee hereby idemnifies and holds harmless grantor for any
loss arising from grantees use of the easement herein granted.
7. This easement shall not be recorded.

Legal Description of a 30' construction easement situated along the
south line of the Colony West Executive Golf Course (unrecorded plat),
being a portion of the "Fort Lauderdale Truck Farms", as recorded in
Plat Book 4, Page 31 as recorded in Broward County Florida, more
particularly described as follows:
The South 30.0 feet of the N.E. 1/4 of section 8 Township 49 south,
range 4 east together with the south 110.0 feet of parcel "B" (canal
R/W P.B. 80-P19) said land containing 2.00 acre (A.K.A. C.W.E. Golf
Course).
