R-86-,30 A RESOLUTION ACCEPTING A DECLARATION OF COVENANTS AND RESTRICTIONS OFFERED BY TURNPIKE CENTER ASSOCIATES IN CONJUNCTION FOR LANDS ON THE NORTH SIDE OF COMMERCIAL BOULEVARD AT NW 47 TERRACE; AND PROVIDING AN EFFFCTIyE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,FLORIDA: SECTION 1: That the Declaration of Covenants and Restrictions offered by Turnpike Center Associates for lands on the north side of Commercial Boulevard at NW 47 Terrace, is HEREBY ACCEPTED. A copy of said Declaration being attached hereto as Exhibit 1. BECTION 2: That the City Clerk is hereby authorized and directed to record said documents in the public records of Broward County, Florida. SEG.TIQN 3: This Resolution shall become effective immediately upon adoption. LAUDERDALE TRUCK FARMS, according to -the Plat thereof, as recorded in Plat Book 4, Page 31, of the Public Records of Broward County, Florida, being more particularly described as follows: Commencing at the Northeast corner of Tract 8 of said Plat; thence S. 0°12'12"E. along the East line thereof, a distance of 454.07 feet; thence N. 89°15'42"W., a distance of 937.47 feet to the POINT OF BEGINNING of this descrip- tion; thence continue N. 89015'42"W., a distance of 631.77 feet; thence N. 38033'14"W., a distance of 141.49 feet; thence N. 11059'20"W., a distance of 22.36 feet; thence N. 38033'14"W., a distance of 2.05 feet; said last mentioned three courses being coincident with the Easterly right-of- way of Commercial Boulevard pursuant to that certain Right--of-Way Map for Section 86504-2603, as shown on Sheet 4 of 16; thence N. 51°26' 46"E. , a distance of 184.65 feet to a Point of Curvature of a circular curve to the right; thence Northerly and Easterly along the arc of said curve, having a radius of 927.25 feet, an arc distance of 299.58 feet; thence S. 38"33'14"E., a distance of 515.68 feet to the POINT OF BEGINNING. Said lands situate, lying and being in Broward County, Florida. Subject to all easements, reservations and rights -of -way record; voluntarily make the following Declaration of Covenants and Restrictions covering the property, specifying that this Declaration of Covenants and Restrictions shall constitute a covenant running with the land and that this document shall be binding upon the Declarant and upon all persons deriving or taking title through the Declarant. These restrictions, during their lifetime, shall be for the benefit of the City of Tamarac, Florida. 1. The property shall be subject to the following cove- nants and restrictions: a) The subject property shall be limited to the pre- sent and future uses permitted under the City of Tamarac.Zoning District B-11, with the inclusion of the following B-2 uses: (i) Hotel Motel 2. These covenants and restrictions are to run with the land and shall be binding upon all parties and persons deriving or taking title through the Declarant for a period of ninety-nine (99) years from the date these covenants are recorded in the Public Records of Broward County, Florida. This Declaration of Covenants and Restrictions may be amended or removed only by the City of Tamarac, Florida, or such other governmental entity or agency having zoning jurisdiction over the subject property, by a written document of equal formality and dignity and with the approval of the Declarant or its successors in title or assigns and adoption of an appropriate resolution. Any amendment to this Declaration of Covenants and Restrictions or termination thereof shall be recorded in the Public Records of Broward County, . Florida. 3. Invalidation of any one portion of this Declaration of i Covenants and Restrictions or any portion of this document by judgment or court order in no way shall affect any other provi- sions which shall remain in full force and effect. it 4. This Declaration of Covenants and Restrictions is exe- cuted for the purpose of protecting the health, safety and welfare of the occupants of the above descibed lands.
