R-86- 3 3g A RESOLUTION APPROVING AND ACCEPTING A PUBLIC SAFETY INGRESS/EGRESS EASEMENT OFFERED BY BONAIRE ASSOCIATES, LTD., FOR THE WATER PLACE PR JECT; AND PROVIDING AN EFFECTIVE DATE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the Public safety ingress/egress ease- ment offered by Bonaire Associates, Ltd., for the Water Place Project is HEREBY APPROVED and accepted, a copy of said easement being attached hereto as "Exhibit 1". SECTION 2: That the appropriate City officials are hereby authorized to execute said easement on behalf of the City. SECT,IQN3 : That the City Clerk is hereby authorized and directed to record said easement in the public records of Broward County, Florida. PUBLIC SAF� INGRESS/EGRESS EASE= THIS PUBLIC SAFETY INGRESS/EGRESS EASEMENT is made this 8th day of August, 1986 by BONAIRE ASSOCIATES LTD., A Florida Limited Partnership, the owner and holder of the property subject to the plat,easements, and restrictions of record hereinafter more particularly described, as grantor, whose mailing address is 7800 N.W. 78th Street, Tamarac, Florida 33321, does hereby grant to the City of Tamarac, A Florida municipality, as grantee whose mailing address is 5811 N.W. 88th Avenue, Tamarac, Florida 33321, W I T N E S S E T H: WHEREAS, Grantor is the fee simple owner of the real property described on Exhibit "A", attached hereto; (the "Property") and WHEREAS, Grantor desires to create a non-exclusive easement in favor of grantee for ingress and egress over the property, as indicated on Exhibit "A", upon the terms and conditions set forth herein. is NOW, THEREFORE, in consideration of the sum of One Dollar ($1.00) paid to Grantor, the receipt and adequacy of which is hereby acknowledged, and for other good and valuable considerations, Grantor does hereby create, establish and grant a non-exclusive easement on, over, under the through the Property to Grantee for the purpose of permitting public ingress and egress across the property to provide municipal services such as utility maintenance, canal maintenance, fire protection, police protection and urgency and other public safety services.
