A RESOLUTION DECLARING THE WATER AND SEWER
DEVELOPERS AGREEMENT FOR BANYAN LAKES PHASE III

WHEREAS, Crestmark Corporation owes to the City of
Tamarac, in accordance with a Water and Sewer Developers
Agreement for Banyan Lakes Phase III, guaranteed revenues.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF TAMARAC,
FLORIDA:
SECTION 1: That the Water and Sewer Developers
Agreement between the City of Tamarac and Crestmark Corpora-
tion for the Banyan Lakes Phase III Project is hereby de-
clared to be in default because of guaranteed revenue charges
in arrears.
,9CTIQN 2: The City Clerk is hereby authorized and

directed to record this Resolution in the public records of
Broward County, Florida.
SECTION 3: This Resolution shall become effective
immediately upon adoption.
