R-86- 3 715- 2 A RESOLUTION ISSUING DEVELOPMENT ORDER NO. 163-1 FOR A REVISED SITE PLAN FOR 3 UNIVERSITY PARK OFFICE CENTER; AND PRO- VIDING AN EFFECTIVE DAT 4 WHEREAS, pursuant to the instructions of the City Council 5 of Tamarac, Florida, a public meeting has been advertised in 6 accordance with applicable law of the date, time and place of 7 the meeting regarding the review of the application for a 8 revised development order by the applicant for development 9 approval; and 10 WHEREAS, the City Council has examined and ,investigated 11 ~ the application, staff and Planning Commission recommendations; 12 and the attached Development Review Status Sheet dated 10/8/86; 13 and 14 WHEREAS, the City Council reviewed the revised development 15 order and accompanying documents at a public meeting; and 16 WHEREAS, the City Council has determined that the appli- 17 cation is in compliance with all elements of the Comprehensive 18 Plan, or will be in compliance prior to the issuance of a Cer-- 19 tificate of Occupancy for the development that is the subject of 20 the application. 21 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 22 TAMARAC, FLORIDA: 23 SECTION1: That the application for approval of a revised 24 site plan for University Park Office Center, prepared by Sam 25 Engel, AIA, revised September 16, 1986, to reflect elimina- 26 tion of a right turn stacking lane as required by Broward County 27 Engineering Division, is HEREBY APPROVED, subject to the follow- 28 ing conditions: 29 A. Construction is to be in complete compliance with the 30 plans and specifications submitted by the developer to the City 31 of Tamarac as described in Section II of the Development Review 32 Status Sheet and approved engineering drawings. 33 34 35 36 -1- Temp. Commencement of construction shall be no longer than one year from the date of this approval. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The revised development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the revised development order are set forth as follows: ,9EgTIQN 2: Should any section or provision of this' revised development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTIQN 3: This revised development order as cond- tioned shall become effective immediately upon its passage. PASSED, ADOPTED AND APPROVED this day of ,1986.
