R-86-� A RESOLUTION APPROVING AN AGREEMENT WITH IN- TERTRES, N.V. TO ALLOW THE PROPERTY AT THE S. W. CORNER OF UNIVERSITY DRIVE AND N.W. 61 STREET TO BE USED BY THE CITY AND ITS CON- TRACTORS WHILE AT WORK ON UNIVERSITY DRIVE IS IN PROGRESS; AND PROyIpING AN EFFECTIVE DATE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: .iSECTIRN 1: That an agreement with Intertres, N.V. to allow the property at the S.W. corner of University Drive and N.W. 61 Street to be used by the City and its contractors `while at work on University Drive is in progress is HEREBY APPROVED and accepted, a copy of said agreement being attached hereto as "Exhibit 1". Dear Mr. Huegenthal: I am the attorney for Intertres, N.V., a Netherlands Antilles corporation and it owns real property at the captioned location. • It is my understanding that the City of Tamarac and its contractor wish to use this property temporarily, to park equipment and store supplies while working on University Drive. Permission is granted on the following terms and conditions: 1.) This permit may be terminated upon thirty (30) days written notice to the City of Tamarac; 2.) During its usage the City of Tamarac and the contractor shall be responsible, at their expense for cutting grass and weeds and keeping the premises free and clear of litter and debris and not permitting any act or non action that could constitute a nuisance or violation of any Ordinance or statute in connection with the use of the premises; 3.) The City of Tamarac and/or the contractor shall indemnify and save harmless Intertres, N.V. from any and all claims of and person or persons or of any entity for personal injury or property damage that arise by reason of the use of the subject premises by the City of Tamarac and/or its contractor and a Certificate of Insurance shall immediately be furnished to Intertres, N.V. naming it as an insured, as its interest may appear, insuring it against the risks set forth in this paragraph up to the limits of liability set forth on the ...scheduie.attached and identified as SGC-3. If evidence of insurance is not furnished to Intertres, N.V.-this permit =nay be. cancelled immediately; 4.) I am enclosing a copy of an excerpt from the registration of Intertres, N.V., the owner of the property, stating that I am an attorney -in -fact for this Netherlands Antilles corporation. I have signed the letter in that fashion. You have requested that I sign this letter before two witnesses and have it notarized. I will not do so. I do not want this letter recorded or recordable. As stated in the body of the letter I may terminate this permit on behalf of Intertres upon thirty (30) days written notice to the City of Tamarac. I don't want anything on record that would create a cloud at such time as the property is sold or should we attempt to encumber it. Please sign and return a copy of this letter to indicate your • consent and agreement to the terms and conditions imposed and pro- vide evidence of insurance as requested in paragraph 3.) of the letter.
