5 A RESOLUTION ISSUING REVISED DEVELOPMENT
ORDER NO. 166-1 FOR THE MCNAB CORNERS
6 PROJECT AND PROVIDING AN EFFECTIVE DATE.
7 WHEREAS, pursuant to the instructions of the City
6 Council of the City of Tamarac, Florida, a public meeting has
9 been advertised in accordance with applicable law of the
10 date, time and place of the meeting regarding the review of
11 application for a development order by the applicant for
12 development approval; and
13 WHEREAS, the City Council has examined and investigated
14 the application, Staff and Planning Commission recommend-
15 ations; and
16 WHEREAS, the City Council reviewed the revised develop-
17 ment order and accompanying documents at a public meeting;
18 and
19 WHEREAS, the City Council has determined that the
20 application is in compliance with all elements of its Compre-
21 hensive Plan, or will be in compliance prior to the issuance
22 of a Certificate of Occupancy for any unit on the development
23 that is the subject of the application.
24 NOW, THEREFORE, BE -IT RESOLVED BY THE COUNCIL OF THE CITY OF
25 TAMARAC, FLORIDA:
26 SECT'ION 1: That the application for an extension of the
27 date of approval of the final site plan to December 24, 1986
28 is approved subject of the following conditions:
29 A. Construction is to be in complete compliance with
30 the plans and specifications submitted by the
31 developer to the City of Tamarac as described in
32 Section II of the Development Review Status Sheet
33 and approved engineering drawings.
34 B. Commencement of construction shall be no longer
35 than sixty (60) days from December 24, 1986. If the

development does not commence construction by
October 9, 1986, this approval is null and void
unless an extension has been granted in accordance
with applicable regulations.
C. The revised development order is assignable, but an
assignment does not discharge any assignee from
strict compliance with the order unless the City
Council consents to modify any of the original
requirements.
D. Additional conditions established in order to issue
the revised development order are set forth as
follows:
1. Pursuant to Ordinance 86-18, the following
fees are due the City as future Trafficways
Contributions:
28,086 sq.ft. Commercial - $32,043.69
1,800 sq.ft. Office - 304.20
2. The future trafficways contributions and all
other fees in arrears must be paid by December 2.3,
1986.
3. All other fees not already paid must be paid at
the rate in effect at the time the fees are'due.
SECTION 2: Should any section or provision of this
revised development order be declared by a court of competent
jurisdiction to be invalid, the City Council shall determine
if the other portions of the order remain valid or whether
the approval shall be null and void.
